{"id":18850,"date":"2020-01-24T08:21:36","date_gmt":"2020-01-24T07:21:36","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/parite-femmes-hommes-sur-les-listes-de-candidatures-application-de-la-regle-aux-candidats-libres\/"},"modified":"2022-09-19T14:47:06","modified_gmt":"2022-09-19T12:47:06","slug":"parite-femmes-hommes-sur-les-listes-de-candidatures-application-de-la-regle-aux-candidats-libres","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/parite-femmes-hommes-sur-les-listes-de-candidatures-application-de-la-regle-aux-candidats-libres\/","title":{"rendered":"Parit\u00e9 femmes-hommes sur les listes de candidatures : application de la r\u00e8gle aux candidats libres"},"content":{"rendered":"<p class=\"ql-align-justify\">Le Tribunal judiciaire de Brive La Gaillarde, dans un jugement du 17 janvier 2020 (RG n\u00b0 11-19-516), a jug\u00e9 que les r\u00e8gles relatives \u00e0 la repr\u00e9sentation \u00e9quilibr\u00e9e entre les femmes et les hommes s\u2019appliquaient au premier comme au second tour.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Il se rallie \u00e0 la position par ailleurs retenue par le Tribunal d\u2019instance de Courbevoie aux termes d\u2019une d\u00e9cision du 4 octobre 2019 (RG n\u00b0 11-19-000323) et le Tribunal d\u2019instance de Paris dans une s\u00e9rie de jugements rendus le 7 novembre 2019 (RG n\u00b0 11-19-008855, 11-19-008880, 11-19-008836, 11-19-008924, 11-19-008942, 11-19-008936).<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Dans son jugement du 17 janvier 2020, le Tribunal judiciaire de Brive La Gaillarde a notamment consid\u00e9r\u00e9 que lorsque plusieurs si\u00e8ges \u00e9taient \u00e0 pourvoir, les listes de candidats pr\u00e9sent\u00e9s aux premier et second tours devaient \u00eatre conformes \u00e0 l\u2019article L. 2314-30 du Code du travail, ce texte visant non seulement les listes pr\u00e9sent\u00e9es par les organisations syndicales, mais \u00e9galement celles sans \u00e9tiquette syndicale.
