{"id":19200,"date":"2020-06-04T09:06:13","date_gmt":"2020-06-04T07:06:13","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/questions-reponses-sur-lentretien-professionnel\/"},"modified":"2022-09-19T14:47:58","modified_gmt":"2022-09-19T12:47:58","slug":"questions-reponses-sur-lentretien-professionnel","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/questions-reponses-sur-lentretien-professionnel\/","title":{"rendered":"Questions-R\u00e9ponses sur l&rsquo;entretien professionnel"},"content":{"rendered":"<p class=\"ql-align-justify\">Le Minist\u00e8re du Travail a r\u00e9cemment publi\u00e9 sur son site internet un questions-r\u00e9ponses relatif \u00e0 l\u2019entretien professionnel adapt\u00e9 \u00e0 l\u2019\u00e9pid\u00e9mie de COVID-19.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Il a compil\u00e9 les principales probl\u00e9matiques rencontr\u00e9es par les employeurs dans la mise en \u0153uvre de leurs obligations en mati\u00e8re d\u2019entretiens d\u2019\u00e9valuation des salari\u00e9s\u00a0:<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">1.\u00a0Les conditions de justification des obligations de l\u2019employeur en mati\u00e8re d\u2019abondement du compte personnel de formation (CPF), issues des articles L.6315-1 et L. 6323-13 du Code du travail, sont-elles cumulatives ou exclusives\u00a0?<\/p>\n<p class=\"ql-align-justify\">L\u2019employeur respecte-t-il son obligation \u00e0 partir du moment o\u00f9 l\u2019un des deux crit\u00e8res est justifi\u00e9 ou bien doit-il justifier des deux crit\u00e8res de mani\u00e8re cumulative\u00a0?<\/p>\n<p class=\"ql-align-justify\">2. Quelles sont les formations consid\u00e9r\u00e9es comme obligatoires au titre de l\u2019article L.\u00a06321-2 du Code du travail\u00a0?<\/p>\n<p class=\"ql-align-justify\">3. En quoi consiste la p\u00e9riode transitoire pr\u00e9vue par l\u2019ordonnance n\u00b0 2019-861 du 21 ao\u00fbt 2019\u00a0?<\/p>\n<p class=\"ql-align-justify\">4. Le droit d\u2019option pour les entreprises de plus de 50 salari\u00e9s instaur\u00e9 par l\u2019ordonnance n\u00b0 2019-861 du 21 ao\u00fbt 2019 s\u2019applique-t-il au niveau de l\u2019entreprise ou s\u2019applique-t-il salari\u00e9 par salari\u00e9\u00a0?<\/p>\n<p class=\"ql-align-justify\">5. Comment s\u2019entend la \u00ab\u00a0progression salariale ou professionnelle\u00a0\u00bb pr\u00e9vue \u00e0 l\u2019article L.\u00a06315-1 du Code du travail\u00a0?<\/p>\n<p class=\"ql-align-justify\">6. Des tol\u00e9rances sont-elles pr\u00e9vues en cas de non-respect de la p\u00e9riodicit\u00e9 des entretiens pour une cause non inh\u00e9rente \u00e0 l\u2019employeur (absence du salari\u00e9, par exemple)\u00a0?<\/p>\n<p class=\"ql-align-justify\">7. Qui contr\u00f4le le respect des obligations mentionn\u00e9es \u00e0 l\u2019article L. 6315-1 du Code du travail\u00a0?<\/p>\n<p class=\"ql-align-justify\">8. L\u2019entretien professionnel peut-il \u00eatre r\u00e9alis\u00e9 sous forme de visioconf\u00e9rence\u00a0?<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Le questions-r\u00e9ponses int\u00e8gre les cons\u00e9quences pratiques des adaptations d\u00e9j\u00e0 apport\u00e9es par l\u2019ordonnance n\u00b0 2020-387 du 1<sup>er<\/sup> avril 2020 portant mesures d\u2019urgence en mati\u00e8re de formation professionnelle, \u00e0 savoir\u00a0:<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<ul>\n<li class=\"ql-align-justify\">Les entretiens d\u2019\u00e9valuation pr\u00e9vus en 2020, faisant l\u2019\u00e9tat des lieux r\u00e9capitulatif du parcours professionnel du salari\u00e9, pourront avoir lieu jusqu\u2019au 31 d\u00e9cembre 2020,<\/li>\n<li class=\"ql-align-justify\">Les dispositions qui pr\u00e9voient un abondement correctif au CPF du salari\u00e9, si celui-ci n&rsquo;a pas b\u00e9n\u00e9fici\u00e9 des obligations pr\u00e9vues, sont suspendues en 2020.
