{"id":19364,"date":"2020-09-04T09:26:36","date_gmt":"2020-09-04T07:26:36","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/sanction-penale-encourue-pour-lemployeur-qui-ferait-prendre-aux-salaries-leurs-repos-dans-les-vehicules-utilitaires-legers\/"},"modified":"2022-09-19T14:48:18","modified_gmt":"2022-09-19T12:48:18","slug":"sanction-penale-encourue-pour-lemployeur-qui-ferait-prendre-aux-salaries-leurs-repos-dans-les-vehicules-utilitaires-legers","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/sanction-penale-encourue-pour-lemployeur-qui-ferait-prendre-aux-salaries-leurs-repos-dans-les-vehicules-utilitaires-legers\/","title":{"rendered":"Sanction p\u00e9nale encourue pour l\u2019employeur qui ferait prendre aux salari\u00e9s leurs repos dans les v\u00e9hicules utilitaires l\u00e9gers"},"content":{"rendered":"<p class=\"ql-align-justify\">Le d\u00e9cret n\u00b02020-1104 du 31 ao\u00fbt 2020 institue une contravention en cas de violation par l\u2019employeur des dispositions pr\u00e9vues par l\u2019article L.3313-4 du Code des transports.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Conform\u00e9ment \u00e0 cet article, \u00ab\u00a0<em style=\"color: black;\">l&#8217;employeur assure au conducteur d&rsquo;un v\u00e9hicule n&rsquo;exc\u00e9dant pas un poids maximum autoris\u00e9 de 3,5 tonnes, utilis\u00e9 pour une op\u00e9ration de transport routier suffisamment \u00e9loign\u00e9e du centre op\u00e9rationnel de l&rsquo;entreprise pour que le conducteur ne puisse y retourner \u00e0 la fin de sa journ\u00e9e de travail, des conditions d&rsquo;h\u00e9bergement, hors du v\u00e9hicule, compatibles avec la dignit\u00e9 humaine et des conditions d&rsquo;hygi\u00e8ne respectueuses de sa sant\u00e9.
