{"id":19403,"date":"2020-09-30T08:55:54","date_gmt":"2020-09-30T06:55:54","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/nouveau-decret-relatif-a-lactivite-partielle-et-a-lapld\/"},"modified":"2022-09-19T14:48:22","modified_gmt":"2022-09-19T12:48:22","slug":"nouveau-decret-relatif-a-lactivite-partielle-et-a-lapld","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/nouveau-decret-relatif-a-lactivite-partielle-et-a-lapld\/","title":{"rendered":"Nouveau d\u00e9cret relatif \u00e0 l\u2019activit\u00e9 partielle et \u00e0 l\u2019APLD"},"content":{"rendered":"<p>Un d\u00e9cret paru au Journal officiel de ce mercredi 29 septembre pr\u00e9cise et adapte certaines modalit\u00e9s relatives \u00e0 l\u2019activit\u00e9 partielle de droit commun et \u00e0 l\u2019APLD.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Mesures relatives \u00e0 l\u2019APLD<\/strong><\/li>\n<\/ul>\n<p><\/p>\n<p>Initialement, le d\u00e9cret du 28 juillet 2020 pr\u00e9voyait que l&rsquo;autorit\u00e9 administrative demande \u00e0 l&#8217;employeur le remboursement \u00e0 l&rsquo;Agence de service et de paiement des sommes per\u00e7ues pour chaque salari\u00e9 plac\u00e9 en activit\u00e9 partielle sp\u00e9cifique et <strong>\u00ab&nbsp;dont le contrat de travail est rompu&nbsp;\u00bb,<\/strong> pendant la dur\u00e9e de recours au dispositif, pour l&rsquo;une des causes \u00e9nonc\u00e9es \u00e0 l&rsquo;article L. 1233-3 du Code du travail.<\/p>\n<p>&nbsp;<\/p>\n<p>Le d\u00e9cret du 29 septembre pr\u00e9voit d\u00e9sormais que le remboursement peut \u00eatre sollicit\u00e9 pour chaque salari\u00e9 plac\u00e9 en activit\u00e9 partielle sp\u00e9cifique et <strong>\u00ab&nbsp;dont le licenciement est prononc\u00e9&nbsp;\u00bb<\/strong>, pendant la dur\u00e9e de recours au dispositif, pour l\u2019une des causes \u00e9nonc\u00e9es \u00e0 l\u2019article L. 1233-3 du Code du travail.<\/p>\n<p>&nbsp;<\/p>\n<p>Le d\u00e9cret pr\u00e9cise par ailleurs que le taux horaire de l\u2019allocation vers\u00e9e \u00e0 l\u2019employeur pour chaque salari\u00e9 plac\u00e9 en APLD est \u00e9gal \u00e0 60 % de la r\u00e9mun\u00e9ration horaire brute, dans la limite de 4,5 fois le Smic (avec un plancher fix\u00e9 \u00e0 7,23 \u20ac), et ce quelle que soit la date de conclusion de l\u2019accord. Rappelons que le d\u00e9cret du 28 juillet 2020 avait initialement introduit une distinction en pr\u00e9voyant que ce taux passait de 60 % \u00e0 56 % pour les accords transmis \u00e0 l&rsquo;autorit\u00e9 administrative \u00e0 compter du 1<sup>er<\/sup> octobre 2020.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Mesure relative \u00e0 l\u2019activit\u00e9 partielle de droit commun <\/strong><\/li>\n<\/ul>\n<p><\/p>\n<p>Le d\u00e9cret du 29 septembre r\u00e9tablit le d\u00e9lai de 15 jours d\u2019acceptation implicite des demandes d\u2019autorisation de placement en activit\u00e9 partielle.
