{"id":19503,"date":"2020-11-13T10:17:40","date_gmt":"2020-11-13T09:17:40","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/parution-dun-q-r-de-la-cnil-sur-le-teletravail\/"},"modified":"2022-09-19T14:48:35","modified_gmt":"2022-09-19T12:48:35","slug":"parution-dun-q-r-de-la-cnil-sur-le-teletravail","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/parution-dun-q-r-de-la-cnil-sur-le-teletravail\/","title":{"rendered":"Parution d\u2019un Q\/R de la CNIL sur le t\u00e9l\u00e9travail"},"content":{"rendered":"<p>La g\u00e9n\u00e9ralisation du t\u00e9l\u00e9travail induit corollairement une utilisation accrue des outils de connexion personnels (le fameux BYOD ou \u00ab\u00a0<em>Bring Your Own Device<\/em>\u00a0\u00bb) et des traitements automatis\u00e9s de donn\u00e9es.<\/p>\n<p><\/p>\n<p>Dans ce contexte, la CNIL se devait d\u2019apporter ses propres pr\u00e9cisions sur les conditions de recours au t\u00e9l\u00e9travail et de rappeler certains principes essentiels d\u00e9rivant du Code du travail et du RGPD en la mati\u00e8re.<\/p>\n<p><\/p>\n<p>Aussi, la CNIL a agr\u00e9ment\u00e9 son guide des bonnes pratiques en mati\u00e8re de t\u00e9l\u00e9travail d\u2019un Q\/R publi\u00e9 le 12 novembre sur son site internet. Dans le cadre de ce Q\/R, elle rappelle notamment\u00a0que :<\/p>\n<p><\/p>\n<ul>\n<li>Le t\u00e9l\u00e9travail n\u2019\u00e9tant qu\u2019une modalit\u00e9 d\u2019organisation de travail, l\u2019employeur conserve son pouvoir de contr\u00f4le de l\u2019ex\u00e9cution des t\u00e2ches confi\u00e9es aux salari\u00e9s. La CNIL pr\u00e9cise n\u00e9anmoins que ce contr\u00f4le n\u2019est pas sans limite\u00a0:<\/li>\n<li>Les dispositifs mis en \u0153uvre doivent \u00eatre proportionn\u00e9s \u00e0 l\u2019objectif poursuivi et ne pas porter atteinte au respect des droits et libert\u00e9s des salari\u00e9s,<\/li>\n<li>L\u2019employeur ne doit pas oublier de (i.) consulter ses repr\u00e9sentants du personnel sur le d\u00e9ploiement de ces dispositifs et (ii.) d\u2019en informer pr\u00e9alablement ses salari\u00e9s,<\/li>\n<li>L\u2019employeur est soumis \u00e0 une obligation de loyaut\u00e9 qui l\u2019interdit de \u00ab\u00a0pi\u00e8ger\u00a0\u00bb ses salari\u00e9s,<\/li>\n<li>L\u2019employeur ne peut se saisir du t\u00e9l\u00e9travail pour placer ses salari\u00e9s sous une surveillance permanent (via une utilisation constante de la webcam ou le partage permanent de l\u2019\u00e9cran\u2026), la CNIL recommandant au contraire le d\u00e9ploiement d\u2019une r\u00e9flexion en entreprise sur l\u2019adaptation des m\u00e9thodes d\u2019encadrement \u00e0 ces nouvelles modalit\u00e9s de travail,<\/li>\n<li>Le niveau de s\u00e9curit\u00e9 et de confidentialit\u00e9 des donn\u00e9es personnelles trait\u00e9es doit \u00eatre identique que l\u2019\u00e9quipement informatique utilis\u00e9 par les salari\u00e9s soit professionnel ou personnel.
