L. 3123-1 du Code du travail).<\/p>\n<p>\u00a0<\/p>\n<p>Le contrat de travail \u00e0 temps partiel doit faire l&rsquo;objet d&rsquo;un formalisme strict dont l&rsquo;irrespect peut entra\u00eener la requalification dudit contrat en contrat \u00e0 temps plein et, partant, l&rsquo;octroi de rappels de salaire.<\/p>\n<p>\u00a0<\/p>\n<p>Par deux arr\u00eats rendus le 9 d\u00e9cembre 2020, la Cour de cassation a affirm\u00e9 que la qualification de travail \u00e0 temps partiel et le formalisme aff\u00e9rent n&rsquo;\u00e9taient pas li\u00e9s \u00e0 la dur\u00e9e du contrat de travail mais s&rsquo;appr\u00e9ciaient au regard de la dur\u00e9e de travail du salari\u00e9 concern\u00e9.<\/p>\n<p>\u00a0<\/p>\n<p>Dans ces arr\u00eats, la Haute juridiction s&rsquo;est appuy\u00e9e notamment sur le droit de l&rsquo;Union europ\u00e9enne (Accord-cadre sur le travail \u00e0 temps partiel du 6 juin 1997, mise en \u0153uvre par la directive 97\/81\/CE du 15 d\u00e9cembre 1997) et a appliqu\u00e9 la m\u00e9thode dite de la \u00ab\u00a0comparaison\u00a0\u00bb.<\/p>\n<p>\u00a0<\/p>\n<p>Ainsi, elle a retenu qu&rsquo;un travailleur \u00e0 temps partiel \u00e9tait le salari\u00e9 dont la dur\u00e9e normale de travail, calcul\u00e9e sur une base hebdomadaire ou en moyenne sur une p\u00e9riode d&#8217;emploi pouvant aller jusqu&rsquo;\u00e0 un an, \u00e9tait inf\u00e9rieure \u00e0 celle d&rsquo;un \u00ab\u00a0travailleur \u00e0 temps plein comparable\u00a0\u00bb.<\/p>\n<p>\u00a0<\/p>\n<p>Elle a pr\u00e9cis\u00e9 qu&rsquo;un \u00ab\u00a0travailleur \u00e0 temps plein comparable\u00a0\u00bb \u00e9tait un salari\u00e9 :<\/p>\n<ul>\n<li>\u00e0 temps plein ;<\/li>\n<li>du m\u00eame \u00e9tablissement ;<\/li>\n<li>ayant le m\u00eame type de contrat de travail ou de relation de travail ;<\/li>\n<li>occupant un travail ou un emploi identique ou similaire ;<\/li>\n<li>avec, le cas \u00e9ch\u00e9ant, la prise en compte de l&rsquo;anciennet\u00e9, des qualifications ou des comp\u00e9tences similaires.<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<p>\u00a0<a
