{"id":19858,"date":"2021-05-12T10:33:13","date_gmt":"2021-05-12T08:33:13","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/precisions-sur-le-point-de-depart-de-la-prescription-de-laction-en-requalification-de-contrats-a-duree-determinee\/"},"modified":"2022-09-19T14:49:17","modified_gmt":"2022-09-19T12:49:17","slug":"precisions-sur-le-point-de-depart-de-la-prescription-de-laction-en-requalification-de-contrats-a-duree-determinee","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/precisions-sur-le-point-de-depart-de-la-prescription-de-laction-en-requalification-de-contrats-a-duree-determinee\/","title":{"rendered":"Pr\u00e9cisions sur le point de d\u00e9part de la prescription de l\u2019action en requalification de contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e"},"content":{"rendered":"<p>L\u2019action en requalification de contrats \u00e0 dur\u00e9e d\u00e9termin\u00e9e en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e rel\u00e8ve de la prescription biennale applicable aux actions portant sur l\u2019ex\u00e9cution du contrat de travail \u00e9nonc\u00e9e \u00e0 l\u2019article L. 1471-1 du Code du travail.<\/p>\n<p><\/p>\n<p>S\u2019agissant du point de d\u00e9part de ce d\u00e9lai de prescription de deux ans, la Cour de cassation op\u00e8re une distinction selon l&rsquo;irr\u00e9gularit\u00e9 soulev\u00e9e \u00e0 l&rsquo;appui de la demande de requalification du CDD en CDI.<\/p>\n<p><\/p>\n<p>Ainsi, la Haute juridiction a pu juger que le d\u00e9lai de prescription de l&rsquo;action en requalification fond\u00e9e <u>sur l&rsquo;absence d&rsquo;une mention obligatoire<\/u> courait \u00e0 compter de la date de conclusion du contrat irr\u00e9gulier. (Cass. soc., 3 mai 2018, n\u00b016-26437).
