La soci\u00e9t\u00e9 Indeed a rompu sa p\u00e9riode d\u2019essai le 1<sup>er<\/sup> octobre 2015.<\/p>\n<p><\/p>\n<p>Le contrat de travail qui la liait avec la soci\u00e9t\u00e9 Monster pr\u00e9voyait une clause de non concurrence de 12 mois \u00e0 compter de la date de rupture de son contrat de travail.<\/p>\n<p><\/p>\n<p>La salari\u00e9e r\u00e9clamait \u00e0 la soci\u00e9t\u00e9 Monster le versement de l\u2019indemnit\u00e9 de non concurrence. Cette derni\u00e8re a n\u00e9anmoins \u00e9t\u00e9 d\u00e9bout\u00e9e en appel au motif que la contrepartie p\u00e9cuniaire de la clause de non concurrence n\u2019est due que si clause a \u00e9t\u00e9 \u00ab\u00a0<em>respect\u00e9e dans son ensemble<\/em>\u00a0\u00bb.<\/p>\n<p><\/p>\n<p>Cette analyse est confirm\u00e9e par la Cour de Cassation dans l\u2019arr\u00eat rendue le 5 mai dernier qui rappelle que l\u2019indemnit\u00e9 de non concurrence n\u2019est pas due au salari\u00e9 qui viole l\u2019interdiction de concurrence, et ce peu important que la salari\u00e9e ait respect\u00e9, comme elle le pr\u00e9tendait, la clause apr\u00e8s la rupture de sa p\u00e9riode d\u2019essai chez le concurrent.<\/p>\n<p><\/p>\n<p>Le fait qu\u2019elle ait perdu rapidement son nouvel emploi ne lui redonne pas droit \u00e0 cette indemnit\u00e9.<\/p>\n<p><\/p>\n<p>Rappelons qu\u2019il convient toujours de se poser la question de l\u2019opportunit\u00e9 d\u2019une clause de non concurrence au moment de la rupture du contrat de travail.
