class=\"ql-align-justify\">Selon la Cour de cassation, l\u2019\u00e9tablissement de la repr\u00e9sentativit\u00e9 syndicale pour toute la dur\u00e9e du cycle \u00e9lectoral ne porte pas atteinte aux droits et libert\u00e9s garantis par la Constitution.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">La jurisprudence r\u00e9cente d\u00e9duit des articles L.2143-3, L.2314-2 et L.2122-1 du Code du travail que la repr\u00e9sentativit\u00e9 des organisations syndicales est \u00e9tablie pour toute la dur\u00e9e du cycle \u00e9lectoral, y compris en cas de modification du p\u00e9rim\u00e8tre de l\u2019entreprise (Cass. soc. 19 f\u00e9vrier 2014, n\u00b013-14.608, n\u00b013-20.069, n\u00b012-29.354, n\u00b013-17.445, n\u00b013-16.750).<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Saisie d\u2019une question prioritaire de Constitutionnalit\u00e9, la Cour de cassation a \u00e9t\u00e9 amen\u00e9e \u00e0 se prononcer quant \u00e0 la conformit\u00e9 de ces dispositions l\u00e9gales, telles qu\u2019interpr\u00e9t\u00e9es par la jurisprudence, aux principes de libert\u00e9 syndicale et de participation des travailleurs, garantis par le pr\u00e9ambule de la Constitution.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Il \u00e9tait soutenu que cette interpr\u00e9tation faisait obstacle, jusqu\u2019aux nouvelles \u00e9lections, \u00e0 ce qu\u2019une organisation syndicale reconnue repr\u00e9sentative dans un \u00e9tablissement puisse, lorsque cet \u00e9tablissement est absorb\u00e9 par un autre, d\u00e9signer un d\u00e9l\u00e9gu\u00e9 syndical dans cet autre \u00e9tablissement pour que la collectivit\u00e9 des salari\u00e9s de l\u2019\u00e9tablissement absorb\u00e9 soit repr\u00e9sent\u00e9e, au seul motif que cette organisation syndicale n\u2019a pas \u00e9t\u00e9 d\u00e9clar\u00e9e repr\u00e9sentative dans l\u2019\u00e9tablissement absorbant aux derni\u00e8res \u00e9lections.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Aux termes d\u2019un arr\u00eat du 16 juin 2021 (n\u00b021-13.141), la Cour de cassation a cependant consid\u00e9r\u00e9 que les dispositions l\u00e9gales, telles qu\u2019interpr\u00e9t\u00e9es par la jurisprudence constante de la Cour de cassation, ne m\u00e9connaissaient ni la libert\u00e9 syndicale, ni le principe de participation des travailleurs, au motif qu\u2019elles \u00e9taient justifi\u00e9es par un objectif de stabilit\u00e9 de la mesure de la repr\u00e9sentativit\u00e9 syndicale pour toute la dur\u00e9e d\u2019un cycle \u00e9lectoral de fa\u00e7on \u00e0 permettre l\u2019effectivit\u00e9 de la n\u00e9gociation collective au sein de l\u2019entreprise et qui \u00e9taient similaires \u00e0 celles retenues par le l\u00e9gislateur pour la repr\u00e9sentativit\u00e9 syndicale au niveau de la branche professionnelle et au niveau national et interprofessionnel.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\"><a
