{"id":19966,"date":"2021-07-15T15:13:34","date_gmt":"2021-07-15T13:13:34","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/avant-projet-de-loi-relatif-a-ladaptation-de-nos-outils-de-gestion-de-la-crise-sanitaire-premiere-ebauche-de-larticulation-entre-la-gestion-des-salaries-et-l\/"},"modified":"2022-09-19T14:49:30","modified_gmt":"2022-09-19T12:49:30","slug":"avant-projet-de-loi-relatif-a-ladaptation-de-nos-outils-de-gestion-de-la-crise-sanitaire-premiere-ebauche-de-larticulation-entre-la-gestion-des-salaries-et-l","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/avant-projet-de-loi-relatif-a-ladaptation-de-nos-outils-de-gestion-de-la-crise-sanitaire-premiere-ebauche-de-larticulation-entre-la-gestion-des-salaries-et-l\/","title":{"rendered":"Avant-projet de loi relatif \u00e0 \u00ab l\u2019adaptation de nos outils de gestion de la crise sanitaire \u00bb : premi\u00e8re \u00e9bauche de l\u2019articulation entre la gestion des salari\u00e9s et l\u2019obligation vaccinale"},"content":{"rendered":"<p class=\"ql-align-justify\">Dans la foul\u00e9e des annonces du Pr\u00e9sident de la R\u00e9publique relatives \u00e0 l\u2019obligation vaccinale des personnels de sant\u00e9 et aux nouvelles restrictions conditionnant l\u2019acc\u00e8s \u00e0 certains lieux \u00e0 la pr\u00e9sentation d\u2019un certificat de vaccination ou d\u2019un d\u00e9pistage virologique n\u00e9gatif, un avant-projet de loi a \u00e9t\u00e9 pr\u00e9sent\u00e9.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Aux termes de ce projet de texte, plusieurs pr\u00e9cisions s\u2019agissant de la gestion des salari\u00e9s sont \u00e0 signaler.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Ainsi, le texte pr\u00e9cise d&rsquo;abord que les <strong>d\u00e9placements de longue distance en transport public<\/strong> et <strong>l\u2019acc\u00e8s \u00e0 certains lieux <\/strong>seraient limit\u00e9s aux personnes immunis\u00e9es ou non-atteintes par la covid-19 pour les activit\u00e9s suivantes\u00a0:<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les activit\u00e9s de loisirs\u00a0;<\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les activit\u00e9s de restauration ou de d\u00e9bit de boisson\u00a0;<\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les foires et salons professionnels\u00a0;<\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les services et \u00e9tablissements accueillant des personnes vuln\u00e9rables\u00a0;<\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les grands \u00e9tablissements et centres commerciaux<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Ainsi, les salari\u00e9s\u00a0exer\u00e7ant dans un de ces contextes <strong>devraient pr\u00e9senter \u00e0 leur employeur <\/strong>l&rsquo;un des justificatifs suivants\u00a0:<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Le <strong>r\u00e9sultat n\u00e9gatif<\/strong> d\u2019un examen de d\u00e9pistage virologique\u00a0;<\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Le <strong>justificatif de statut vaccinal<\/strong> contre la covid-19\u00a0;<\/p>\n<p class=\"ql-align-justify\">\u2010\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Le <strong>certificat de r\u00e9tablissement<\/strong> suite \u00e0 une contamination \u00e0 la covid-19<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Le texte indique ensuite qu\u2019\u00e0 d\u00e9faut de pr\u00e9senter l\u2019un de ces justificatifs, <strong>les salari\u00e9s ne pourraient plus exercer leurs fonctions. <\/strong>Le fait pour un salari\u00e9 de ne pas pouvoir exercer son activit\u00e9 en raison de la non-pr\u00e9sentation de ces justificatifs<strong> pendant une p\u00e9riode de plus de deux mois justifierait son licenciement pour ce motif. <\/strong>Il semblerait donc que le texte cr\u00e9e un motif de licenciement <em>sui generis<\/em> des salari\u00e9s concern\u00e9s.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Le texte ne pr\u00e9cise cependant pas, en l\u2019\u00e9tat, les modalit\u00e9s de d\u00e9compte du d\u00e9lai de deux mois, ni s\u2019il s\u2019agirait d\u2019un d\u00e9lai continu ou cumul\u00e9.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">L\u2019avant-projet de loi pr\u00e9voit \u00e9galement une <strong>autorisation d\u2019absence<\/strong> pour les salari\u00e9s devant se rendre \u00e0 un rendez-vous de vaccination.
