d\u00e9cret"},"content":{"rendered":"<p class=\"ql-align-justify\"><span style=\"color: black;\">Le d\u00e9cret n\u00b0 2021-1002 du 30 juillet 2021 relatif aux crit\u00e8res objectifs de d\u00e9finition des cat\u00e9gories de salari\u00e9s b\u00e9n\u00e9ficiaires d&rsquo;une couverture de protection sociale compl\u00e9mentaire collective a \u00e9t\u00e9 publi\u00e9 au Journal officiel du 31 juillet 2021.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Le d\u00e9cret adapte et actualise les r\u00e9f\u00e9rences aux conventions et accords interprofessionnels relatifs aux garanties de pr\u00e9voyance des salari\u00e9s mentionn\u00e9es aux articles R. 242-1-1 et R. 242-1-2 du code de la s\u00e9curit\u00e9 sociale, afin de tenir compte de l&rsquo;accord national interprofessionnel du 17 novembre 2017 relatif \u00e0 la pr\u00e9voyance des cadres, qui annule et remplace notamment les stipulations de la convention collective nationale du 14 mars 1947. <\/span><\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Comme l\u2019indique la notice du d\u00e9cret, pour des raisons de stabilit\u00e9 de la norme et de s\u00e9curit\u00e9 juridique, le texte maintient le p\u00e9rim\u00e8tre actuel des cat\u00e9gories de cadres et de non-cadres en permettant aux branches professionnelles, pour le b\u00e9n\u00e9fice de garanties de protection sociale compl\u00e9mentaire, de pouvoir assimiler \u00e0 des cadres des cat\u00e9gories de salari\u00e9s ne correspondant pas aux d\u00e9finitions \u00e9tablies par les ANI du 17 novembre 2017, d\u00e8s lors que les cat\u00e9gories cadres et non-cadres ainsi d\u00e9finies sont valid\u00e9es par la commission paritaire rattach\u00e9e \u00e0 l&rsquo;Association pour l&#8217;emploi des cadres (APEC).<\/span><\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Le d\u00e9cret entre en vigueur le premier jour du sixi\u00e8me mois qui suit celui de sa publication au Journal officiel.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">On notera que les contributions des employeurs destin\u00e9es au financement des prestations de protection sociale compl\u00e9mentaire qui b\u00e9n\u00e9ficient, \u00e0 la date d&rsquo;entr\u00e9e en vigueur du d\u00e9cret, de l&rsquo;exclusion de l&rsquo;assiette des cotisations de s\u00e9curit\u00e9 sociale en application des dispositions des articles R. 242-1-1 et R. 242-1-2 du m\u00eame code dans leur r\u00e9daction ant\u00e9rieure \u00e0 l&rsquo;entr\u00e9e en vigueur du d\u00e9cret et qui ne remplissent pas les conditions fix\u00e9es par les dispositions de ces articles issues du d\u00e9cret, continuent d&rsquo;en b\u00e9n\u00e9ficier jusqu&rsquo;au 31 d\u00e9cembre 2024, sous r\u00e9serve qu&rsquo;aucune modification des accords, conventions ou d\u00e9cisions unilat\u00e9rales de l&#8217;employeur relative au champ des b\u00e9n\u00e9ficiaires des garanties n&rsquo;intervienne avant cette m\u00eame date.<\/p>\n<p
