Ils cr\u00e9ent un lien entre \u00e9lectorat et \u00e9ligibilit\u00e9, dans la mesure o\u00f9 ne peuvent \u00eatre \u00e9lus que des salari\u00e9s \u00e9lecteurs. <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">De jurisprudence constante, la Cour de cassation interpr\u00e8te ces textes en ce sens que ne peuvent ni exercer un mandat de repr\u00e9sentation du personnel, ni \u00eatre \u00e9lecteurs les salari\u00e9s qui soit disposent d\u2019une d\u00e9l\u00e9gation \u00e9crite particuli\u00e8re d\u2019autorit\u00e9 leur permettant d\u2019\u00eatre assimil\u00e9s au chef d\u2019entreprise, soit repr\u00e9sentent effectivement l\u2019employeur devant les institutions repr\u00e9sentatives du personnel.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Selon la Haute Juridiction, l\u2019article L. 2314-18 du Code du travail \u00e9carte donc les personnes in\u00e9ligibles en application de l\u2019article L. 2314-9 de la possibilit\u00e9 de participer, en tant qu\u2019\u00e9lecteur \u00e0 l\u2019\u00e9lection des membres du comit\u00e9 social et \u00e9conomique. <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">La solution a \u00e9t\u00e9 r\u00e9cemment rappel\u00e9e s\u2019agissant des directeurs de magasins d\u2019un grand groupe de distribution, exclus de l\u2019\u00e9lectorat, dans la mesure o\u00f9 ils repr\u00e9sentaient effectivement l\u2019employeur devant les institutions repr\u00e9sentatives du personnel (Cass. Soc. 31 mars 2021, n\u00b0 19-25.233). <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Est-elle toutefois conforme aux dispositions constitutionnelles, et en particulier \u00e0 l\u2019alin\u00e9a 8 du Pr\u00e9ambule de la Constitution du 27 octobre 1946 instaurant le principe de participation des travailleurs\u00a0? <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">C\u2019est la question \u00e0 laquelle devra prochainement r\u00e9pondre le Conseil constitutionnel. <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Par jugement du 17 juin 2021, le tribunal judiciaire de Bourg-en-Bresse a transmis une question prioritaire de constitutionnalit\u00e9 ainsi r\u00e9dig\u00e9e\u00a0:<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: black;\">\u00ab\u00a0La disposition de l\u2019article L. 2314-18 du code du travail telle qu\u2019interpr\u00e9t\u00e9e par la jurisprudence de la Cour de cassation, en privant certains travailleurs de la qualit\u00e9 d\u2019\u00e9lecteur aux \u00e9lections professionnelles, et en n\u2019encadrant pas mieux les conditions de cette exclusion<\/em><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: black;\">Estimant que cette question pr\u00e9sentait un caract\u00e8re s\u00e9rieux, la Cour de cassation l\u2019a renvoy\u00e9e au Conseil Constitutionnel par d\u00e9cision du 15 septembre dernier.
