{"id":20150,"date":"2021-11-02T07:24:24","date_gmt":"2021-11-02T06:24:24","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/la-procedure-dagrement-des-accords-de-branche-depargne-salariale-est-fixee\/"},"modified":"2022-09-19T14:49:52","modified_gmt":"2022-09-19T12:49:52","slug":"la-procedure-dagrement-des-accords-de-branche-depargne-salariale-est-fixee","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/la-procedure-dagrement-des-accords-de-branche-depargne-salariale-est-fixee\/","title":{"rendered":"La proc\u00e9dure d\u2019agr\u00e9ment des accords de branche d\u2019\u00e9pargne salariale est fix\u00e9e"},"content":{"rendered":"<p><span style=\"color: rgb(0, 0, 0);\">Un d\u00e9cret n\u00b0 2021-1398 du 27 octobre pr\u00e9cisant les conditions et d\u00e9lais d\u2019agr\u00e9ment des accords de branche d\u2019\u00e9pargne salariale a \u00e9t\u00e9 publi\u00e9 au Journal Officiel du 29 octobre 2021. <\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Il est entr\u00e9 en vigueur le 1er novembre 2021.\u00a0<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Pour rappel, diff\u00e9rentes mesures relatives \u00e0 l\u2019\u00e9pargne salariale ont \u00e9t\u00e9 instaur\u00e9es par la loi d\u2019acc\u00e9l\u00e9ration et de simplification de l\u2019action publique (dite \u00ab\u00a0loi Asap\u00a0\u00bb) publi\u00e9e le 9 d\u00e9cembre 2020. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Une n\u00e9gociation doit notamment \u00eatre men\u00e9e au sein de chaque branche professionnelle en vue de la mise en place d\u2019un r\u00e9gime d\u2019int\u00e9ressement, de participation ou d\u2019\u00e9pargne salariale avant le 31 d\u00e9cembre 2021. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Une proc\u00e9dure d\u2019agr\u00e9ment de ces accords a \u00e9galement \u00e9t\u00e9 instaur\u00e9e par cette loi. Elle permet aux entreprises entrant dans leur champ d\u2019application de mettre en place des dispositifs d\u2019\u00e9pargne salariale par adh\u00e9sion \u00e0 ces accords de branches. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Le d\u00e9cret n\u00b0 2021-1398 du 27 octobre 2021 pr\u00e9cise les conditions et les d\u00e9lais de cette proc\u00e9dure d\u2019agr\u00e9ment des accords de branche d\u2019int\u00e9ressement, de participation ou instaurant un plan d\u2019\u00e9pargne salariale conduite par l\u2019autorit\u00e9 administrative comp\u00e9tente \u00e0 compter de leur d\u00e9p\u00f4t. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Il pr\u00e9voit\u00a0que : <\/span><\/p>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">La proc\u00e9dure ne concerne que les accords de branches qui pr\u00e9voient une adh\u00e9sion des entreprises, par accord ou d\u00e9cision unilat\u00e9rale\u00a0; <\/span><\/li>\n<\/ul>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">Le ministre du travail est l\u2019autorit\u00e9 administrative comp\u00e9tente pour d\u00e9livrer l\u2019agr\u00e9ment\u00a0; <\/span><\/li>\n<\/ul>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">Le d\u00e9lai de la proc\u00e9dure d\u2019agr\u00e9ment est de 6 mois \u00e0 compter du d\u00e9p\u00f4t de l\u2019accord ou de l\u2019avenant (avec une possibilit\u00e9 de prorogation pour 6 mois suppl\u00e9mentaires). A noter que la loi pr\u00e9voyait d\u00e9j\u00e0 que l\u2019absence de d\u00e9cision dans le d\u00e9lai pr\u00e9vu vaut agr\u00e9ment. <\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Le d\u00e9cret s\u2019int\u00e9resse \u00e9galement aux r\u00e8gles relatives \u00e0 l\u2019adh\u00e9sion des entreprises aux accords conclus au niveau de la branche. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Ainsi\u00a0: <\/span><\/p>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">Lorsque l\u2019adh\u00e9sion s\u2019effectue par accord (dans le cas des entreprises d\u2019au moins 50 salari\u00e9s), cet accord doit pr\u00e9ciser l\u2019option retenue par l\u2019entreprise si l\u2019accord de branche propose plusieurs options (choix ferm\u00e9s) ou le contenu des choix si l\u2019accord de branche laisse cette possibilit\u00e9 \u00e0 l\u2019entreprise (choix ouverts)\u00a0;<\/span><\/li>\n<\/ul>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">Lorsque l\u2019adh\u00e9sion s\u2019effectue par d\u00e9cision unilat\u00e9rale de l\u2019employeur (dans les entreprises de moins de 50 salari\u00e9s, et lorsque l\u2019accord de branche pr\u00e9voit cette possibilit\u00e9 et propose un \u00ab\u00a0accord type\u00a0\u00bb indiquant les diff\u00e9rents choix laiss\u00e9s \u00e0 l\u2019employeur), le d\u00e9cret pr\u00e9cise que cet accord-type ne peut comporter que des options dont les param\u00e8tres sont fix\u00e9s par l\u2019accord de branche sans adaptation possible par l\u2019employeur. <\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Cette nouvelle proc\u00e9dure ne concerne que les nouveaux accords ou avenants de branche d\u00e9pos\u00e9s \u00e0 compter du 1<\/span><sup style=\"color: rgb(0, 0, 0);\">er<\/sup><span style=\"color: rgb(0, 0, 0);\"> novembre 2021.\u00a0<\/span><\/p>\n<p><\/p>\n<p><a
