{"id":20162,"date":"2021-11-15T09:53:00","date_gmt":"2021-11-15T08:53:00","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/validation-par-le-conseil-constitutionnel-du-projet-de-loi-portant-diverses-dispositions-de-vigilance-sanitaire\/"},"modified":"2022-09-19T14:49:53","modified_gmt":"2022-09-19T12:49:53","slug":"validation-par-le-conseil-constitutionnel-du-projet-de-loi-portant-diverses-dispositions-de-vigilance-sanitaire","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/validation-par-le-conseil-constitutionnel-du-projet-de-loi-portant-diverses-dispositions-de-vigilance-sanitaire\/","title":{"rendered":"Validation par le Conseil Constitutionnel du projet de loi portant diverses dispositions de vigilance sanitaire"},"content":{"rendered":"<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">Aux termes d\u2019une d\u00e9cision du 9 novembre 2021, le Conseil constitutionnel a valid\u00e9 les principales dispositions du projet de loi portant diverses dispositions de vigilance sanitaire, d\u00e9finitivement adopt\u00e9 par le Parlement le 5 novembre 2021.<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">Le Conseil constitutionnel a notamment valid\u00e9\u00a0:<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0la prorogation jusqu\u2019au 31 juillet 2022 des dispositions organisant le cadre juridique de l\u2019\u00e9tat d\u2019urgence sanitaire et de la p\u00e9riode pendant laquelle le premier ministre peut prendre par d\u00e9cret \u00e0 des fins de lutte contre la propagation de l\u2019\u00e9pid\u00e9mie de Covid-19, des mesures relevant du r\u00e9gime de gestion de la sortie de crise sanitaire et subordonner l\u2019acc\u00e8s \u00e0 certains lieux \u00e0 la d\u00e9tention d\u2019un passe sanitaire. Le Gouvernement pourra ainsi maintenir ou r\u00e9tablir le pass sanitaire apr\u00e8s le 15 novembre 2021\u00a0;<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0la prolongation des dispositions d\u00e9rogatoires en mati\u00e8re d\u2019indemnit\u00e9s compl\u00e9mentaires vers\u00e9es par l\u2019employeur en cas d\u2019arr\u00eat de travail li\u00e9 \u00e0 la Covid-19. Les dispositions prises par d\u00e9cret en la mati\u00e8re resteront applicables jusqu\u2019\u00e0 une date fix\u00e9e par d\u00e9cret et au plus tard jusqu\u2019au 31 juillet 2022.<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">Il a, en revanche, censur\u00e9\u00a0:<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0la disposition qui habilitait le gouvernement \u00e0 prendre par ordonnance des mesures visant \u00e0 l\u2019adaptation du dispositif d\u2019activit\u00e9 partielle de longue dur\u00e9e (APLD) et qui devait permettre de prolonger sa mise en \u0153uvre au-del\u00e0 du premier semestre 2022\u00a0;<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0la disposition qui pr\u00e9voyait d\u2019autoriser le gouvernement \u00e0 r\u00e9tablir, \u00e0 adapter ou \u00e0 compl\u00e9ter par ordonnance, y compris de mani\u00e8re r\u00e9troactive sur un mois, les mesures relevant du domaine de la loi en mati\u00e8re d\u2019indemnit\u00e9s compl\u00e9mentaires.<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(28, 28, 28);\">Cette censure est fond\u00e9e sur des arguments proc\u00e9duraux. En effet, il n\u2019appartient qu\u2019au gouvernement de demander au Parlement une habilitation \u00e0 prendre des ordonnances pour adapter la loi.
