!"},"content":{"rendered":"<p><span style=\"color: rgb(0, 0, 0);\">En cas d\u2019impossibilit\u00e9 de reclasser un salari\u00e9 inapte, l\u2019employeur doit faire conna\u00eetre par \u00e9crit au salari\u00e9 inapte les motifs qui s\u2019opposent \u00e0 son reclassement avant d\u2019engager la proc\u00e9dure de licenciement (L.1226-2-1 CT, L.1226-12 CT). <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">A d\u00e9faut, il s\u2019expose \u00e0 des dommages int\u00e9r\u00eats dont le montant varie en fonction du pr\u00e9judice subi.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">La Cour de cassation consid\u00e8re n\u00e9anmoins qu\u2019un salari\u00e9 dont le licenciement pour inaptitude a \u00e9t\u00e9 jug\u00e9 sans cause r\u00e9elle et s\u00e9rieuse ne peut pas pr\u00e9tendre \u00e0 une indemnit\u00e9 pour d\u00e9faut d\u2019information sur les motifs emp\u00eachant le reclassement. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Il n\u2019y a pas de cumul possible de cette indemnit\u00e9 avec l\u2019indemnit\u00e9 pour licenciement sans cause r\u00e9elle et s\u00e9rieuse<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Elle rappelle dans un arr\u00eat du 15 d\u00e9cembre 2021 n\u00b020-18.782 publi\u00e9 au bulletin (portant par ailleurs sur l&rsquo;application du bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb : cf. notre actu du m\u00eame jour \u00e0 ce sujet) que \u00ab <\/span><em style=\"color: rgb(0, 0, 0);\">l&rsquo;indemnit\u00e9 en r\u00e9paration du pr\u00e9judice subi du fait de l&rsquo;absence de notification \u00e9crite des motifs qui s&rsquo;opposent au reclassement\u00a0<\/em><span style=\"color: rgb(0, 0, 0);\">\u00bb et \u00ab\u00a0<\/span><em style=\"color: rgb(0, 0, 0);\">l&rsquo;indemnit\u00e9 pour licenciement sans cause r\u00e9elle et s\u00e9rieuse<\/em><span style=\"color: rgb(0, 0, 0);\">\u00a0\u00bb sont \u00ab <\/span><em style=\"color: rgb(0, 0, 0);\">exclusives l\u2019une de l\u2019autre<\/em><span style=\"color: rgb(0, 0, 0);\"> \u00bb.<\/span><\/p>\n<p><span style=\"color: rgb(0, 0,
