{"id":20322,"date":"2022-01-28T09:07:02","date_gmt":"2022-01-28T08:07:02","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/amenagement-temporaire-des-locaux-de-restauration\/"},"modified":"2022-09-19T14:50:12","modified_gmt":"2022-09-19T12:50:12","slug":"amenagement-temporaire-des-locaux-de-restauration","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/amenagement-temporaire-des-locaux-de-restauration\/","title":{"rendered":"Am\u00e9nagement temporaire des locaux de restauration"},"content":{"rendered":"<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">Le d\u00e9cret n\u00b0 2022-61 du 25 janvier 2022 r\u00e9instaure temporairement la possibilit\u00e9 d\u2019am\u00e9nager les dispositions du code du travail relatives aux locaux de restauration.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Le d\u00e9cret am\u00e9nage les conditions de restauration, lorsque la configuration du local de restauration ou de l&#8217;emplacement normalement d\u00e9di\u00e9 \u00e0 la restauration ne permet pas de garantir le respect des r\u00e8gles de distanciation physique d\u00e9finies dans le cadre de la lutte contre l&rsquo;\u00e9pid\u00e9mie de covid-19. Ces dispositions sont applicables jusqu&rsquo;au 30 avril 2022. Compte tenu de l&rsquo;\u00e9volution de la situation sanitaire, cette date pourra \u00eatre report\u00e9e par d\u00e9cret et au plus tard jusqu&rsquo;au 31 juillet 2022.<\/span><\/p>\n<p class=\"ql-align-justify\">&nbsp;<\/p>\n<p class=\"ql-align-justify\"><u style=\"color: black;\">Dans les \u00e9tablissements d&rsquo;au moins 50 salari\u00e9s<\/u><span style=\"color: black;\">, l\u2019employeur peut pr\u00e9voir un ou plusieurs autres emplacements de restauration, m\u00eame s\u2019ils ne comportent pas l&rsquo;ensemble des \u00e9quipements impos\u00e9s par le Code du travail. Ces emplacements peuvent \u00eatre situ\u00e9s \u00e0 l&rsquo;int\u00e9rieur des locaux affect\u00e9s au travail.<\/span><\/p>\n<p class=\"ql-align-justify\">&nbsp;<\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Ils doivent permettre aux travailleurs de se restaurer dans des conditions, s\u2019agissant en particulier de l\u2019am\u00e9nagement et de l\u2019hygi\u00e8ne des lieux, pr\u00e9servant leur sant\u00e9 et leur s\u00e9curit\u00e9. Ils ne peuvent pas \u00eatre situ\u00e9s dans des locaux dont l&rsquo;activit\u00e9 comporte l&#8217;emploi ou le stockage de substances ou de m\u00e9langes dangereux.<\/span><\/p>\n<p class=\"ql-align-justify\">&nbsp;<\/p>\n<p class=\"ql-align-justify\"><u style=\"color: black;\">Dans les \u00e9tablissements de moins de 50 salari\u00e9s<\/u><span style=\"color: black;\">, l\u2019employeur peut pr\u00e9voir un ou plusieurs autres emplacements de restauration. Ils doivent permettre aux travailleurs de se restaurer dans des conditions, s&rsquo;agissant en particulier de l&rsquo;am\u00e9nagement des lieux et de l&rsquo;hygi\u00e8ne, de sant\u00e9 et de s\u00e9curit\u00e9 s&rsquo;agissant de l&rsquo;am\u00e9nagement et de l&rsquo;hygi\u00e8ne des lieux.<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Ces emplacements peuvent \u00eatre situ\u00e9s dans des locaux affect\u00e9s au travail.
