{"id":20346,"date":"2022-02-10T12:38:44","date_gmt":"2022-02-10T11:38:44","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/entretien-annuel-devaluation-vigilance-sur-le-contenu-du-compte-rendu-ecrit\/"},"modified":"2022-09-19T14:50:15","modified_gmt":"2022-09-19T12:50:15","slug":"entretien-annuel-devaluation-vigilance-sur-le-contenu-du-compte-rendu-ecrit","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/entretien-annuel-devaluation-vigilance-sur-le-contenu-du-compte-rendu-ecrit\/","title":{"rendered":"Entretien annuel d\u2019\u00e9valuation : vigilance sur le contenu du compte rendu \u00e9crit"},"content":{"rendered":"<p class=\"ql-align-justify\">Dans un arr\u00eat du 2 f\u00e9vrier 2022, la Cour de cassation consid\u00e8re que le compte rendu \u00e9crit d\u2019un entretien annuel d\u2019\u00e9valuation faisant \u00e9tat de mani\u00e8re expresse de reproches au salari\u00e9 et le mettant en demeure de changer de fa\u00e7on drastique son comportement caract\u00e9rise un avertissement disciplinaire, \u00e9puisant le pouvoir disciplinaire de l\u2019employeur (Cass. soc., 2 f\u00e9vr. 2022, n\u00b0 20-13.833).<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">En l\u2019esp\u00e8ce, l\u2019employeur reprochait, dans le compte rendu \u00e9crit de l\u2019entretien annuel d\u2019\u00e9valuation d\u2019un salari\u00e9 responsable de la maintenance <em>\u00ab\u00a0son attitude dure et ferm\u00e9e aux changements\u00a0\u00bb<\/em> et l\u2019invitait <em>\u00ab\u00a0de mani\u00e8re imp\u00e9rative et comminatoire et sans d\u00e9lai \u00e0 un changement complet et total\u00a0\u00bb<\/em>.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Un mois plus tard, le salari\u00e9 est licenci\u00e9 pour faute grave en raison de cette attitude.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Le salari\u00e9 a saisi la juridiction prud\u2019homale en contestation de ce licenciement. Au dernier \u00e9tat, la Cour d\u2019appel avait consid\u00e9r\u00e9 ce licenciement abusif, en reconnaissant le caract\u00e8re disciplinaire du compte rendu de l\u2019entretien d\u2019\u00e9valuation, qui avait donc \u00e9puis\u00e9 le pouvoir disciplinaire de l\u2019employeur.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">La soci\u00e9t\u00e9 a form\u00e9 un pourvoi en soutenant que le compte rendu de l\u2019entretien d\u2019\u00e9valuation ne pouvait pas \u00eatre regard\u00e9 comme une mesure disciplinaire alors que l\u2019intention de sanctionner le salari\u00e9 n\u2019y \u00e9tait pas manifest\u00e9e.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">La Cour de cassation rejette le pourvoi form\u00e9 par la soci\u00e9t\u00e9 et consid\u00e8re que <strong>le compte rendu d\u2019entretien, d\u00e8s lors qu\u2019il comportait des griefs pr\u00e9cis, caract\u00e9risait un avertissement, de sorte que les m\u00eames faits ne pouvaient plus justifier un licenciement ult\u00e9rieur.<\/strong><\/p>\n<p class=\"ql-align-justify\"><strong>\u00a0<\/strong><\/p>\n<p class=\"ql-align-justify\">Pour rappel, constitue une sanction disciplinaire <strong>toute mesure, autre que verbale,<\/strong> prise par l\u2019employeur \u00e0 l\u2019encontre d\u2019un salari\u00e9 \u00e0 la suite d\u2019un comportement consid\u00e9r\u00e9 comme fautif (C. trav., art. L. 1331-1).<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Dans ce cadre, la Cour de cassation consid\u00e8re que les reproches \u00e9crits faits \u00e0 un salari\u00e9 caract\u00e9risent un avertissement disciplinaire, ind\u00e9pendamment de la qualification ou de la forme donn\u00e9e \u00e0 la mesure (not.
