de licenciement et pluralit\u00e9 de motifs"},"content":{"rendered":"<p>Par une d\u00e9cision du 21 avril 2022 <em>(n\u00b020-14.408), <\/em>la Cour de cassation a jug\u00e9 qu\u2019un employeur pouvait invoquer plusieurs motifs personnels dans la lettre de licenciement notifi\u00e9e au salari\u00e9.<\/p>\n<p>\u00a0<\/p>\n<p>Dans cette affaire, un employeur a notifi\u00e9 \u00e0 l\u2019un de ses salari\u00e9s un licenciement pour insuffisance professionnelle et pour faute grave, que le salari\u00e9 a contest\u00e9 devant le Conseil de prud\u2019hommes.<\/p>\n<p>\u00a0<\/p>\n<p>Les juges du fond, apr\u00e8s avoir retenu que <em>\u00ab\u00a0le grief d\u2019insuffisance professionnelle est \u00e9tabli\u00a0\u00bb,<\/em> ont consid\u00e9r\u00e9 que celui fond\u00e9 sur la faute grave n\u2019\u00e9tait pas d\u00e9montr\u00e9 et, par cons\u00e9quent, ont jug\u00e9 que le licenciement \u00e9tait d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse et ont condamn\u00e9 l\u2019employeur au paiement de diverses sommes \u00e0 ce titre au salari\u00e9.<\/p>\n<p>\u00a0<\/p>\n<p>Saisie d&rsquo;un pourvoi form\u00e9 par l\u2019employeur, la Cour de cassation a pr\u00e9cis\u00e9 que <em>\u00ab\u00a0l\u2019employeur, \u00e0 condition de respecter les r\u00e8gles applicables \u00e0 chaque cause de licenciement, peut invoquer dans les lettres de licenciement des motifs diff\u00e9rents de rupture inh\u00e9rents \u00e0 la personne du salari\u00e9, d\u00e8s lors qu\u2019ils proc\u00e8dent de faits distincts\u00a0\u00bb,<\/em> puis a cass\u00e9 l\u2019arr\u00eat des juges du fond, en leur reprochant de ne pas avoir recherch\u00e9 si cette insuffisance professionnelle, qui \u00e9tait \u00e9tablie, pouvait constituer une cause r\u00e9elle et s\u00e9rieuse de licenciement.<\/p>\n<p>\u00a0<\/p>\n<p>A l\u2019aune de cette d\u00e9cision, l\u2019employeur est donc en mesure d\u2019invoquer tant une insuffisance professionnelle que des griefs disciplinaires, dans une lettre de licenciement, en prenant le soin de respecter les dispositions l\u00e9gales aff\u00e9rentes \u00e0 chacun de ces motifs et de veiller \u00e0 ce que ces motifs visent des faits distincts.\u00a0<\/p>\n<p>\u00a0<\/p>\n<p><a
