{"id":20616,"date":"2022-06-27T12:49:40","date_gmt":"2022-06-27T10:49:40","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/ues-validite-de-la-designation-syndicale-aupres-dune-seule-personne\/"},"modified":"2022-09-19T14:50:47","modified_gmt":"2022-09-19T12:50:47","slug":"ues-validite-de-la-designation-syndicale-aupres-dune-seule-personne","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/ues-validite-de-la-designation-syndicale-aupres-dune-seule-personne\/","title":{"rendered":"UES : validit\u00e9 de la d\u00e9signation syndicale aupr\u00e8s d\u2019une seule personne"},"content":{"rendered":"<p class=\"ql-align-justify\">Dans un arr\u00eat rendu le 15 juin 2022, la Cour de cassation rappelle la validit\u00e9 de la d\u00e9signation syndicale \u00e0 une seule personne intervenant dans une unit\u00e9 \u00e9conomique et sociale (UES) d\u00e9j\u00e0 reconnue (Cass. soc., 15 juin 2022, n\u00b0 21-10.509).<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">En l\u2019esp\u00e8ce, une salari\u00e9e d\u2019une soci\u00e9t\u00e9 franchis\u00e9e d\u2019une enseigne de restauration rapide avait \u00e9t\u00e9 licenci\u00e9e pour faute grave sans autorisation pr\u00e9alable de l&rsquo;inspecteur du travail, en d\u00e9pit de la notification par courrier, intervenue juste avant sa convocation, de sa d\u00e9signation en qualit\u00e9 de d\u00e9l\u00e9gu\u00e9e syndicale aupr\u00e8s du pr\u00e9sident commun de plusieurs soci\u00e9t\u00e9s franchis\u00e9es constituant une UES d\u00e9j\u00e0 reconnue.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">C\u2019est dans ce cadre que la salari\u00e9e sollicitait, en r\u00e9f\u00e9r\u00e9, la reconnaissance d\u2019un trouble manifestement illicite et sa r\u00e9int\u00e9gration sous astreinte.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Les juges du fond ayant fait droit aux demandes de la salari\u00e9e, la soci\u00e9t\u00e9 s\u2019est pourvue en cassation en soutenant que la d\u00e9signation intervenue aupr\u00e8s du seul pr\u00e9sident commun des entit\u00e9s de l\u2019UES ne pouvait \u00eatre opposable au chef d\u2019\u00e9tablissement de l\u2019une des soci\u00e9t\u00e9 de l\u2019UES \u00e0 laquelle appartenait la salari\u00e9e.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">La Cour de cassation rejette le pourvoi et rappelle le principe selon lequel la <em>\u00ab\u00a0d\u00e9signation d\u2019un d\u00e9l\u00e9gu\u00e9 syndical ou d\u2019un repr\u00e9sentant de section syndicale au sein d\u2019une unit\u00e9 \u00e9conomique et sociale d\u00e9j\u00e0 reconnue <\/em><strong><em>est valablement notifi\u00e9e \u00e0 une seule personne lorsque celle-ci a la qualit\u00e9 de pr\u00e9sident des entit\u00e9s juridiques composant l\u2019unit\u00e9 \u00e9conomique et sociale<\/em><\/strong><em>\u00a0\u00bb<\/em>.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Or, dans la mesure o\u00f9 toutes les soci\u00e9t\u00e9s franchis\u00e9es de l\u2019UES avaient un seul et m\u00eame pr\u00e9sident, la seule notification \u00e0 ce dernier suffisait, sans qu\u2019il soit besoin de notifier \u00e9galement la d\u00e9signation syndicale au chef de l\u2019\u00e9tablissement concern\u00e9.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Ainsi, il convient d\u2019\u00eatre particuli\u00e8rement vigilant lorsque des d\u00e9signations syndicales interviennent dans une UES. En effet, la solution n\u2019aurait pas \u00e9t\u00e9 la m\u00eame si la d\u00e9signation n\u2019avait pas couvert l\u2019ensemble de l\u2019UES, mais seulement un \u00e9tablissement distinct de ce dernier (not. Cass. soc., 30 mai 2001, n\u00b0 99-60.535) ou si l\u2019UES n\u2019avait pas encore \u00e9t\u00e9 reconnue mais uniquement revendiqu\u00e9e par le syndicat (not.
