rendu le 3 novembre 2016 (Cass. soc. 3 novembre 2016, n\u00b015-18444), la Cour de cassation a \u00e9tendu la pr\u00e9somption de justification d\u2019une diff\u00e9rence de traitement applicable aux avantages cat\u00e9goriels, aux avantages r\u00e9serv\u00e9s par la voie d\u2019accord d\u2019\u00e9tablissement, aux seuls salari\u00e9s d\u2019un \u00e9tablissement. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Ainsi, la Haute Cour rappelle qu\u2019il existe une pr\u00e9somption de justification aux diff\u00e9rences de traitement instaur\u00e9es entre salari\u00e9s appartenant \u00e0 la m\u00eame entreprise mais \u00e0 des \u00e9tablissements distincts, op\u00e9r\u00e9es par voie d\u2019accords d\u2019\u00e9tablissement n\u00e9goci\u00e9s et sign\u00e9s par des organisations syndicales repr\u00e9sentatives au sein de ces \u00e9tablissements, investies de la d\u00e9fense des droits et int\u00e9r\u00eats des salari\u00e9s de l\u2019\u00e9tablissement et \u00e0 l\u2019habilitation desquelles ces derniers participent directement par leur vote. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Toutefois, cette pr\u00e9somption peut \u00eatre combattue par celui qui conteste cette diff\u00e9rence de traitement d\u00e8s lors qu\u2019il d\u00e9montre que les avantages conventionnels sont \u00e9trangers \u00e0 des consid\u00e9rations de nature professionnelles.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Par deux arr\u00eats en date du 28 septembre 2022 (n\u00b021-15356 et n\u00b020-23510), rendus dans des esp\u00e8ces diff\u00e9rentes, la Cour de cassation n\u2019a pas manqu\u00e9 de rappeler ces solutions.<strong><\/strong><\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Dans le 1<sup>er<\/sup> arr\u00eat (n\u00b021-15356), l\u2019employeur avait \u00e9t\u00e9 condamn\u00e9 par la Cour d\u2019appel \u00e0 payer diverses sommes au salari\u00e9 \u00e0 titre de rappel de prime panier. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Pour entrer en voie de condamnation, la Cour d\u2019appel avait consid\u00e9r\u00e9 que l\u2019accord d\u2019\u00e9tablissement ent\u00e9rinant le principe d\u2019une prime panier exceptionnelle accord\u00e9e exclusivement aux salari\u00e9s affect\u00e9s \u00e0 un \u00e9tablissement X \u00e9tait de nature \u00e0 justifier les diff\u00e9rences de traitement entre salari\u00e9s appartenant \u00e0 la m\u00eame entreprise mais affect\u00e9s \u00e0 des \u00e9tablissements distincts, de sorte qu\u2019il appartenait \u00e0 la salari\u00e9e concern\u00e9e de d\u00e9montrer que ces diff\u00e9rences de traitement \u00e9taient \u00e9trang\u00e8res \u00e0 toute consid\u00e9ration de nature professionnelle. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Le juge d\u2019appel avait retenu que la prime panier attribu\u00e9e aux salari\u00e9s de l\u2019\u00e9tablissement X \u00e9tait per\u00e7ue de fa\u00e7on forfaitaire et identique quel que soit leur lieu d\u2019habitation, que cette prime n\u2019\u00e9tait pas vers\u00e9e en fonction de la distance s\u00e9parant le domicile des salari\u00e9s de leur lieu de travail les emp\u00eachant de rentrer d\u00e9jeuner chez eux, et que le co\u00fbt des repas sur place pouvait \u00eatre variable, ce qui ne constituait pas une raison objective d\u2019attribution de la prime.<\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">La Cour de cassation a cass\u00e9 l\u2019arr\u00eat d\u2019appel en rappelant que l\u2019accord d\u2019\u00e9tablissement instaurant cet avantage permettait de pr\u00e9sumer que les diff\u00e9rences de traitement entre des salari\u00e9s appartenant \u00e0 la m\u00eame entreprise mais affect\u00e9s \u00e0 des \u00e9tablissements distincts \u00e9taient justifi\u00e9s, de sorte que le juge d\u2019appel avait viol\u00e9 le principe susvis\u00e9. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">Dans le 2<sup>nd<\/sup> arr\u00eat, l\u2019employeur avait \u00e9t\u00e9 \u00e9galement condamn\u00e9 par la Cour d\u2019appel au paiement cette fois-ci d\u2019une prime de fin d\u2019ann\u00e9e, d\u2019une prime de trajet et d\u2019une prime de panier \u00e0 un salari\u00e9. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">La Cour d\u2019appel avait consid\u00e9r\u00e9 que le salari\u00e9 d\u00e9montrait que l\u2019attribution de ces diff\u00e9rentes primes accord\u00e9es aux salari\u00e9s appartenant \u00e0 la m\u00eame entreprise, mais rattach\u00e9s \u00e0 un \u00e9tablissement distinct, avantages instaur\u00e9s par voie d\u2019accord d\u2019\u00e9tablissement, n\u2019\u00e9taient pas justifi\u00e9es par des raisons objectives. <\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\">La Haute Cour casse l\u2019arr\u00eat d\u2019appel et rappelle que la pr\u00e9somption de justification ne peut tomber que lorsque celui qui la conteste rapporte la preuve que l\u2019avantage litigieux est \u00e9tranger \u00e0 toute consid\u00e9ration de nature professionnelle. <\/p>\n<p><\/p>\n<p><a
