{"id":22053,"date":"2022-11-22T20:14:49","date_gmt":"2022-11-22T19:14:49","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=22053"},"modified":"2022-11-22T20:14:49","modified_gmt":"2022-11-22T19:14:49","slug":"inaptitude-mention-expresse-de-limpossibilite-de-reclassement-et-consultation-du-cse-confirmation-de-la-cour-de-cassation","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/inaptitude-mention-expresse-de-limpossibilite-de-reclassement-et-consultation-du-cse-confirmation-de-la-cour-de-cassation\/","title":{"rendered":"Inaptitude, mention expresse de l\u2019impossibilit\u00e9 de reclassement et consultation du CSE : confirmation de la Cour de Cassation"},"content":{"rendered":"<p class=\"ql-align-justify\"><span style=\"color: black;\">Aux termes d\u2019un arr\u00eat de cassation rendu le 16 novembre 2022 <\/span><em style=\"color: black;\">(n\u00b021-17.255),<\/em><span style=\"color: black;\"> la Cour de Cassation r\u00e9it\u00e8re sa position adopt\u00e9e le 8 juin 2022 <\/span><em style=\"color: black;\">(n\u00b020-22.500)<\/em><span style=\"color: black;\"> et rappelle que \u00ab\u00a0<\/span><em style=\"color: black;\">lorsque le m\u00e9decin du travail a mentionn\u00e9 express\u00e9ment dans son avis que tout maintien du salari\u00e9 dans un emploi serait gravement pr\u00e9judiciable \u00e0 sa sant\u00e9 ou que l\u2019\u00e9tat de sant\u00e9 du salari\u00e9 fait obstacle \u00e0 tout reclassement dans un emploi,\u00a0l\u2019employeur, qui n\u2019est pas tenu de rechercher un reclassement, n\u2019a pas l\u2019obligation de consulter les d\u00e9l\u00e9gu\u00e9s du personnel<\/em><span style=\"color: black;\">\u00a0\u00bb.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p><span style=\"color: black;\">En consid\u00e9rant le<\/span><span style=\"color: black; background-color: rgb(250, 250, 250);\">\u00a0licenciement du salari\u00e9 d\u00e9pourvu de cause r\u00e9elle et s\u00e9rieuse, aux motifs qu&rsquo;il r\u00e9sultait de la combinaison des articles L. 1226-2 et L. 1226-2-1 du code du travail que la m\u00e9connaissance des dispositions relatives au reclassement du salari\u00e9 d\u00e9clar\u00e9 inapte cons\u00e9cutivement \u00e0 un accident non professionnel ou une maladie, dont celle imposant \u00e0 l&#8217;employeur de consulter les d\u00e9l\u00e9gu\u00e9s du personnel, privait le licenciement de cause r\u00e9elle et s\u00e9rieuse, peu important que le m\u00e9decin du travail ait dispens\u00e9 l&#8217;employeur de toute recherche de reclassement<\/span><span style=\"color: black;\">, la Cour d\u2019appel d\u2019Amiens avait viol\u00e9 l<\/span><span style=\"color: black; background-color: rgb(250, 250, 250);\">es articles L. 1226-2 et L. 1226-2-1 du code du travail dans leur r\u00e9daction issue de la loi Travail du 8 ao\u00fbt 2016.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: black;\">Cette confirmation de l\u2019arr\u00eat du 8 juin 2022 est salutaire \u00e9tant pr\u00e9cis\u00e9 que la solution est applicable au CSE. Publi\u00e9 au Bulletin, l\u2019arr\u00eat est \u00e9galement destin\u00e9 \u00e0 une large diffusion.<\/span><\/p>\n<p><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: black;\">Cass.
