{"id":22453,"date":"2023-02-23T08:50:18","date_gmt":"2023-02-23T07:50:18","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=22453"},"modified":"2023-02-23T08:50:18","modified_gmt":"2023-02-23T07:50:18","slug":"projet-de-decret-dapplication-sur-la-presomption-de-demission","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/projet-de-decret-dapplication-sur-la-presomption-de-demission\/","title":{"rendered":"Projet de d\u00e9cret d\u2019application sur la pr\u00e9somption de d\u00e9mission"},"content":{"rendered":"<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">Un nouvel article L.1237-1-1 du Code du travail, issu de la loi n\u00b02022-1598 du 21 d\u00e9cembre 2022, pr\u00e9voit une pr\u00e9somption de d\u00e9mission du salari\u00e9 qui a abandonn\u00e9 son poste de travail dans les termes suivants\u00a0:<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00ab\u00a0<\/span><em style=\"color: rgb(0, 0, 0);\">Le salari\u00e9 qui a abandonn\u00e9 volontairement son poste et ne reprend pas le travail apr\u00e8s avoir \u00e9t\u00e9 mis en demeure de justifier son absence et de reprendre son poste, par lettre recommand\u00e9e ou par lettre remise en main propre contre d\u00e9charge, dans le d\u00e9lai fix\u00e9 par l&#8217;employeur, est pr\u00e9sum\u00e9 avoir d\u00e9missionn\u00e9 \u00e0 l&rsquo;expiration de ce d\u00e9lai.<\/em><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: rgb(0, 0, 0);\">[\u2026]<\/em><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: rgb(0, 0, 0);\"> Le d\u00e9lai pr\u00e9vu au premier alin\u00e9a ne peut \u00eatre inf\u00e9rieur \u00e0 un minimum fix\u00e9 par d\u00e9cret en Conseil d&rsquo;Etat.
