{"id":23008,"date":"2023-06-09T09:49:15","date_gmt":"2023-06-09T07:49:15","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=23008"},"modified":"2023-06-09T09:49:15","modified_gmt":"2023-06-09T07:49:15","slug":"publication-detudes-de-la-dares-sur-la-negociation-collective-en-entreprise-et-les-instances-representatives-du-personnel","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/publication-detudes-de-la-dares-sur-la-negociation-collective-en-entreprise-et-les-instances-representatives-du-personnel\/","title":{"rendered":"Publication d\u2019\u00e9tudes de la DARES sur la n\u00e9gociation collective en entreprise et les instances repr\u00e9sentatives du personnel"},"content":{"rendered":"<p>La Direction de l&rsquo;Animation de la Recherche, des \u00c9tudes et des Statistiques (DARES) r\u00e9alise tous les ans une enqu\u00eate sur le dialogue social en entreprise.<\/p>\n<p><\/p>\n<p>Le 1<sup>er<\/sup> juin 2023, elle a publi\u00e9 deux \u00e9tudes consacr\u00e9es respectivement\u00a0:<\/p>\n<p><\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0A la n\u00e9gociation collective en entreprise\u00a0;<\/p>\n<p><\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Aux instances repr\u00e9sentatives du personnel.<\/p>\n<p><\/p>\n<p>Au terme de ces \u00e9tudes, la DARES indique\u00a0qu\u2019en 2021, il y a eu <em>\u00ab\u00a0moins d\u2019instances \u00e9lues mais plus d\u2019implantation syndicale\u00a0\u00bb<\/em>, la part des entreprise d\u00e9clarant la pr\u00e9sence d\u2019au moins une instance repr\u00e9sentative du personnel \u00e9lue ayant diminu\u00e9e, l\u00e0 o\u00f9 celle ayant d\u00e9clar\u00e9 la pr\u00e9sence d\u2019au moins une instance repr\u00e9sentative d\u00e9sign\u00e9e a augment\u00e9.<\/p>\n<p><\/p>\n<p>Elle ajoute qu\u2019il y a eu un <em>\u00ab\u00a0regain de dynamisme\u00a0\u00bb<\/em> de la n\u00e9gociation collective<em> \u00ab\u00a0apr\u00e8s la crise sanitaire\u00a0\u00bb<\/em>, le taux de n\u00e9gociation ayant atteint son plus haut niveau depuis 2012.<\/p>\n<p><\/p>\n<p>Un certain nombre de donn\u00e9es chiffr\u00e9es plus pr\u00e9cises sont fournies.<\/p>\n<p><\/p>\n<p>Ces derni\u00e8res r\u00e9v\u00e8lent notamment que\u00a0:<\/p>\n<p><\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0La propension \u00e0 n\u00e9gocier a augment\u00e9 parmi les entreprises ne disposant que d\u2019\u00e9lus (passant \u00e0 25,2 %, soit une hausse de 2,3 points sur un an)\u00a0;<\/p>\n<p><\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les n\u00e9gociations aboutissent plus fr\u00e9quemment \u00e0 un accord dans les entreprises de grande taille (<em>78% pour les entreprises employant entre 10 et 49 salari\u00e9s et 93,3% pour celles de 500 salari\u00e9s et plus)<\/em> et dans celles disposant de d\u00e9l\u00e9gu\u00e9 syndicaux\u00a0;<\/p>\n<p><\/p>\n<p>&#8211;\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Les salaires restent le th\u00e8me le plus fr\u00e9quemment abord\u00e9 (10,6%), avant les conditions de travail (6,5%), l\u2019\u00e9pargne salariale (5,8%) et l\u2019\u00e9galit\u00e9 professionnelle femme\/homme (4,3%).<\/p>\n<p><\/p>\n<p><a href=\"https:\/\/dares.travail-emploi.gouv.fr\/sites\/default\/files\/979efdfe3bc44478d81599947548e1ca\/DR_IRP_2021.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/dares.travail-emploi.gouv.fr\/sites\/default\/files\/979efdfe3bc44478d81599947548e1ca\/DR_IRP_2021.pdf<\/a><\/p>\n<p><\/p>\n<p><a href=\"https:\/\/dares.travail-emploi.gouv.fr\/sites\/default\/files\/2853a92f89d25afdad5bf2d3f9e097c6\/DR_N%C3%A9gociation%20collective_2021.pdf\" target=\"_blank\" rel=\"noopener\">https:\/\/dares.travail-emploi.gouv.fr\/sites\/default\/files\/2853a92f89d25afdad5bf2d3f9e097c6\/DR_N%C3%A9gociation%20collective_2021.pdf<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Direction de l&rsquo;Animation de la Recherche, des \u00c9tudes et des Statistiques (DARES) r\u00e9alise tous les ans une enqu\u00eate sur le dialogue social en entreprise.
