0);\">A \u00e9t\u00e9 publi\u00e9 au Journal officiel du 1er juillet dernier le d\u00e9cret n\u00b0 2023-547 du 30 juin 2023 relatif au suivi de l&rsquo;\u00e9tat de sant\u00e9 des travailleurs ayant plusieurs employeurs<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">Ce d\u00e9cret d\u00e9taille ainsi les modalit\u00e9s du suivi de l&rsquo;\u00e9tat de sant\u00e9 des travailleurs ayant plusieurs employeurs et occupant des emplois identiques.<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">L\u2019article D. 4624-59 du Code du travail dispose d\u00e9sormais\u00a0:<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00ab\u00a0<\/span><em style=\"color: rgb(0, 0, 0);\">Le suivi de l&rsquo;\u00e9tat de sant\u00e9 pr\u00e9vu \u00e0 l&rsquo;article L. 4624-1-1 est applicable au travailleur qui remplit les conditions suivantes :<\/em><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: rgb(0, 0, 0);\"> \u00ab 1\u00b0 Le travailleur ex\u00e9cute simultan\u00e9ment au moins deux contrats de travail, que ceux-ci soient \u00e0 dur\u00e9e d\u00e9termin\u00e9e ou ind\u00e9termin\u00e9e ;<\/em><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: rgb(0, 0, 0);\"> \u00ab 2\u00b0 Les emplois concern\u00e9s rel\u00e8vent de la m\u00eame cat\u00e9gorie socioprofessionnelle selon la nomenclature des professions et des cat\u00e9gories socioprofessionnelles des emplois salari\u00e9s des employeurs priv\u00e9s et publics.<\/em><\/p>\n<p class=\"ql-align-justify\"><em style=\"color: rgb(0, 0, 0);\"> \u00ab 3\u00b0 Le type de suivi individuel de l&rsquo;\u00e9tat de sant\u00e9 du travailleur est identique pour les postes occup\u00e9s dans le cadre des emplois vis\u00e9s au 2\u00b0<\/em><span style=\"color: rgb(0, 0, 0);\">\u00a0\u00bb.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">L\u2019article D. 4624-60 du m\u00eame Code pr\u00e9cise que\u00a0:\u00a0\u00ab\u00a0<\/span><em style=\"color: rgb(0, 0, 0);\">L&#8217;employeur avec lequel le travailleur entretient la relation contractuelle la plus ancienne, y compris lorsque son contrat de travail a donn\u00e9 lieu \u00e0 transfert l\u00e9gal au sens de l&rsquo;article L. 1224-1 ou conventionnel au sens de l&rsquo;article L. 2253-1, est son employeur principal pour l&rsquo;application des dispositions de la pr\u00e9sente section<\/em><span style=\"color: rgb(0, 0, 0);\">\u00a0\u00bb.<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">Le pr\u00e9sent d\u00e9cret est en vigueur,\u00a0\u00e0 l&rsquo;exception de ses dispositions relatives aux modalit\u00e9s de r\u00e9partition du co\u00fbt de la mutualisation entre les employeurs pr\u00e9vue par son article 1<\/span><sup style=\"color: rgb(0, 0, 0);\">er<\/sup><span style=\"color: rgb(0, 0, 0);\">, qui seront applicables \u00e0 compter du 1<\/span><sup style=\"color: rgb(0, 0, 0);\">er<\/sup><span style=\"color: rgb(0, 0, 0);\"> janvier 2024.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><a
