{"id":23462,"date":"2023-09-28T14:06:07","date_gmt":"2023-09-28T12:06:07","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=23462"},"modified":"2023-09-28T14:06:09","modified_gmt":"2023-09-28T12:06:09","slug":"indemnite-de-conges-payes-precision-de-la-cour-de-cassation-sur-la-base-de-calcul","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/indemnite-de-conges-payes-precision-de-la-cour-de-cassation-sur-la-base-de-calcul\/","title":{"rendered":"Indemnit\u00e9 de cong\u00e9s pay\u00e9s : pr\u00e9cision de la Cour de cassation sur la base de calcul"},"content":{"rendered":"<p><span style=\"color: rgb(0, 0, 0);\">Pendant la p\u00e9riode des cong\u00e9s, le salari\u00e9 peut pr\u00e9tendre \u00e0 une\u00a0indemnit\u00e9 de cong\u00e9s pay\u00e9s, destin\u00e9e \u00e0 compenser sa perte de salaire. <\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Cette indemnit\u00e9 de cong\u00e9s pay\u00e9s peut \u00eatre calcul\u00e9e de deux fa\u00e7ons\u00a0:<\/span><\/p>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">l&rsquo;indemnit\u00e9 de cong\u00e9s pay\u00e9s est \u00e9gale au dixi\u00e8me\u00a0de la r\u00e9mun\u00e9ration brute totale\u00a0per\u00e7ue par le salari\u00e9 au cours de de l\u2019ann\u00e9e de r\u00e9f\u00e9rence \u00e9coul\u00e9e,<\/span><\/li>\n<li><span style=\"color: rgb(0, 0, 0);\">l&rsquo;indemnit\u00e9 de\u00a0cong\u00e9s pay\u00e9s\u00a0est\u00a0\u00e9gale \u00e0 la r\u00e9mun\u00e9ration que le salari\u00e9 aurait per\u00e7ue s&rsquo;il avait continu\u00e9 \u00e0 travailler.<\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">C&rsquo;est le montant le plus avantageux pour le salari\u00e9 qui est pay\u00e9.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">La jurisprudence a d\u00e9termin\u00e9, au fur et \u00e0 mesure, les \u00e9l\u00e9ments de salaire pouvant \u00eatre pris en compte pour d\u00e9terminer le montant de cette indemnit\u00e9. Il s\u2019agit des sommes ayant le caract\u00e8re de salaire ou d\u2019accessoire du salaire, notamment\u00a0:<\/span><\/p>\n<p><\/p>\n<ul>\n<li><span style=\"color: rgb(0, 0, 0);\">le salaire de base ;<\/span><\/li>\n<li><span style=\"color: rgb(0, 0, 0);\">les commissions\u00a0; <\/span><\/li>\n<li><span style=\"color: rgb(0, 0, 0);\">les majorations pour heures suppl\u00e9mentaires, travail de nuit, prime d\u2019astreinte\u00a0; <\/span><\/li>\n<li><span style=\"color: rgb(0, 0, 0);\">le salaire d\u00fb pour des absences assimil\u00e9es \u00e0 du temps de travail effectif\u00a0; <\/span><\/li>\n<li><span style=\"color: rgb(0, 0, 0);\">la prime d\u2019anciennet\u00e9, de rendement ou encore d\u2019assiduit\u00e9.<\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">A l\u2019inverse, les primes exceptionnelles ou facultatives ne sont pas prises en compte dans la base de calcul de l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">R\u00e9cemment, la Cour de cassation est venue pr\u00e9ciser que n&rsquo;ont pas \u00e0 \u00eatre pris en compte dans l&rsquo;assiette de calcul\u00a0de l&rsquo;indemnit\u00e9 de cong\u00e9s pay\u00e9s\u00a0les indemnit\u00e9s et\u00a0avantages en nature\u00a0dont le salari\u00e9 jouit l&rsquo;ensemble de l&rsquo;ann\u00e9e, temps de travail et temps de cong\u00e9 confondus, et dont le montant ou la valeur ne sont pas diminu\u00e9s du fait des cong\u00e9s pay\u00e9s (Cass. soc., 13 septembre 2023 n\u00b021-23.452). <\/span><\/p>\n<p><\/p>\n<p><a href=\"https:\/\/www.courdecassation.fr\/decision\/65015e28ee1a2205e6581716?search_api_fulltext=%22L%2029%22%20%22Code%20%C3%A9lectoral%22&#038;judilibre_juridiction=cc&#038;op=Rechercher%20sur%20judilibre&#038;page=3&#038;previousdecisionpage=3&#038;previousdecisionindex=8&#038;nextdecisionpage=4&#038;nextdecisionindex=0\" target=\"_blank\" rel=\"noopener\">https:\/\/www.courdecassation.fr\/decision\/65015e28ee1a2205e6581716?search_api_fulltext=%22L%2029%22%20%22Code%20%C3%A9lectoral%22&#038;judilibre_juridiction=cc&#038;op=Rechercher%20sur%20judilibre&#038;page=3&#038;previousdecisionpage=3&#038;previousdecisionindex=8&#038;nextdecisionpage=4&#038;nextdecisionindex=0<\/a><\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pendant la p\u00e9riode des cong\u00e9s, le salari\u00e9 peut pr\u00e9tendre \u00e0 une\u00a0indemnit\u00e9 de cong\u00e9s pay\u00e9s, destin\u00e9e \u00e0 compenser sa perte de salaire.
