{"id":23869,"date":"2023-11-17T10:27:37","date_gmt":"2023-11-17T09:27:37","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=23869"},"modified":"2023-11-17T10:27:39","modified_gmt":"2023-11-17T09:27:39","slug":"manquement-a-lobligation-de-securite-de-lemployeur-et-rare-incompetence-materielle-du-juge-prudhomal-en-cas-dat-mp","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/manquement-a-lobligation-de-securite-de-lemployeur-et-rare-incompetence-materielle-du-juge-prudhomal-en-cas-dat-mp\/","title":{"rendered":"Manquement \u00e0 l&rsquo;obligation de s\u00e9curit\u00e9 de l&#8217;employeur et (rare) incomp\u00e9tence mat\u00e9rielle du juge prud&rsquo;homal en cas d&rsquo;AT\/MP"},"content":{"rendered":"<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">Au milieu de la saga judiciaire sur l&rsquo;acquisition des cong\u00e9s pendant la maladie, d&rsquo;autres arr\u00eats sont rendus qui sont moins relay\u00e9s, mais non d\u00e9nu\u00e9s d&rsquo;int\u00e9r\u00eats. <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">C&rsquo;est le cas de l&rsquo;arr\u00eat du 15 novembre 2023 (n\u00b022-18.848), lequel pose la question de la comp\u00e9tence prud&rsquo;homale en mati\u00e8re de r\u00e9paration de pr\u00e9judice subi du fait d&rsquo;un manquement de l&#8217;employeur \u00e0 son obligation de s\u00e9curit\u00e9 (plus particuli\u00e8rement, le <\/span><span style=\"color: rgb(0, 0, 0); background-color: rgb(250, 250, 250);\">d\u00e9passement de la dur\u00e9e moyenne hebdomadaire de travail)<\/span><span style=\"color: rgb(0, 0, 0);\">, d\u00e8s lors que ce manquement a \u00e9t\u00e9 invoqu\u00e9 au soutien d&rsquo;une demande de reconnaissance de maladie professionnelle.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">Les faits sont simples : un salari\u00e9 est licenci\u00e9 pour inaptitude et impossibilit\u00e9 de reclassement. <\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">A la suite de la rupture de son contrat, le salari\u00e9 a introduit une action en reconnaissance de maladie professionnelle devant la juridiction de s\u00e9curit\u00e9 sociale, puis a saisi la juridiction prud&rsquo;homale <\/span><span style=\"color: rgb(0, 0, 0); background-color: rgb(250, 250, 250);\">d&rsquo;une demande de dommages et int\u00e9r\u00eats pour manquement par l&#8217;employeur \u00e0 son obligation de s\u00e9curit\u00e9.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">La r\u00e9ponse de la Cour d&rsquo;appel, confirm\u00e9e par la Cour de cassation, est sans appel : le juge prud&rsquo;homal est mat\u00e9riel incomp\u00e9tent, dans la mesure o\u00f9 le salari\u00e9, sous couvert d\u2019une action en responsabilit\u00e9 contre l\u2019employeur pour manquement \u00e0 l\u2019obligation de s\u00e9curit\u00e9, demande en r\u00e9alit\u00e9 la r\u00e9paration du pr\u00e9judice n\u00e9 de l\u2019accident du travail ou d\u2019une maladie professionnelle le concernant.<\/span><\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\"><span style=\"color: rgb(0, 0, 0);\">La Haute juridiction confirme ainsi sa position (cf. notamment : \u00a0Cass. soc. 3 mai 2018, n\u00b017-10.306\u00a0; Cass. soc. 3 mai 2018, n\u00b016-26.850 ; Cass. soc. 6 novembre 2019, n\u00b018-20.837), consid\u00e9rant que<\/span><em style=\"color: rgb(0, 0, 0);\"><\/em><span style=\"color: rgb(0, 0, 0);\">la juridiction de s\u00e9curit\u00e9 sociale est seule comp\u00e9tente pour conna\u00eetre de l\u2019indemnisation d\u2019un dommage r\u00e9sultant d\u2019un accident du travail ou d\u2019une maladie professionnelle.
