proposition de reclassement et avait \u00e9t\u00e9 licenci\u00e9 plusieurs semaines apr\u00e8s son refus sans que son employeur n\u2019ait repris le paiement du salaire, \u00e0 l\u2019expiration du d\u00e9lai d\u2019un mois apr\u00e8s l\u2019avis d\u2019inaptitude.<\/span><\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">Au visa de l\u2019article L. 1226-4 du Code du travail, la Cour de cassation casse l\u2019arr\u00eat rendu par la Cour d\u2019appel qui avait statu\u00e9 en r\u00e9f\u00e9r\u00e9 et rappelle que <\/span><em style=\"color: black;\">\u00ab\u00a0la circonstance que l\u2019employeur est pr\u00e9sum\u00e9 avoir respect\u00e9 son obligation de reclassement en proposant au salari\u00e9 inapte, un emploi prenant en compte l\u2019avis et les indications du m\u00e9decin du travail , ne le dispense pas de verser au salari\u00e9, qui a refus\u00e9 cette proposition de reclassement et qui n\u2019a pas \u00e9t\u00e9 reclass\u00e9 dans l\u2019entreprise \u00e0 l\u2019issue du d\u00e9lai d\u2019un mois \u00e0 compter de la date de l\u2019examen m\u00e9dical de reprise ou qui n\u2019a pas \u00e9t\u00e9 licenci\u00e9, le salaire correspondant \u00e0 l\u2019emploi qu\u2019il occupait avant la suspension de son contrat de travail\u00a0\u00bb.<\/em><\/p>\n<p class=\"ql-align-justify\">\u00a0<\/p>\n<p class=\"ql-align-justify\"><span style=\"color: black;\">A noter que le collaborateur en question, agent de s\u00e9curit\u00e9, travaillait \u00e0 la Cour d\u2019appel de Rennes <\/span><em style=\"color: black;\">(Cour de Cassation, Chambre Sociale, 10 janvier 2024, n\u00b0 21-20.229).<\/em><\/p>\n<p class=\"ql-align-justify\"><em>\u00a0<\/em><\/p>\n<p class=\"ql-align-justify\"><a
