{"id":25101,"date":"2024-05-17T09:26:29","date_gmt":"2024-05-17T07:26:29","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=25101"},"modified":"2024-05-17T09:26:31","modified_gmt":"2024-05-17T07:26:31","slug":"le-bareme-macron-simpose-aux-juges-du-fond","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/le-bareme-macron-simpose-aux-juges-du-fond\/","title":{"rendered":"Le Bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb s&rsquo;impose aux juges du fond"},"content":{"rendered":"<p><span style=\"color: rgb(0, 0, 0);\">La Cour de Cassation vient de rappeler ce principe une nouvelle fois, dans un arr\u00eat du 7 mai dernier, censurant la Cour d\u2019appel de Douai qui avait cru pouvoir s\u2019\u00e9carter du Bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb pr\u00e9vu \u00e0 l\u2019article L. 1235-3 du Code du travail.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">En l\u2019esp\u00e8ce, les juges douaisiens avaient, en effet, consid\u00e9r\u00e9 que le licenciement jug\u00e9 sans cause r\u00e9elle et s\u00e9rieuse d\u2019un salari\u00e9 m\u00e9ritait une indemnisation au-del\u00e0 du Bar\u00e8me compte tenu des circonstances exceptionnelles du dossier.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Ils avaient ainsi allou\u00e9 30.000 \u20ac de dommages int\u00e9r\u00eats au salari\u00e9 licenci\u00e9, soit 6.000 euros de plus que le Bar\u00e8me compte tenu de l\u2019anciennet\u00e9 du salari\u00e9.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Ils avaient notamment pris en compte le fait que le salari\u00e9 \u00e9tait \u00e2g\u00e9 de 55 ans, \u00e9tait p\u00e8re de 8 enfants, dont 3 encore mineurs, avait des charges d\u2019emprunts et aurait des difficult\u00e9s \u00e9videntes \u00e0 retrouver un emploi.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">A cette occasion, la Cour d\u2019appel de Douai s\u2019\u00e9tait livr\u00e9e \u00e0 une vive critique du Bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb en se fondant notamment sur le principe d\u2019indemnit\u00e9 ad\u00e9quate pr\u00e9vue par l\u2019article 10 de la convention 158 de l\u2019OIT. Elle faisait valoir qu\u2019il devait revenir aux juges de d\u00e9terminer un montant d\u2019indemnit\u00e9 en dehors des limites du Bar\u00e8me lorsqu\u2019il ne permet pas une r\u00e9paration ad\u00e9quate, pr\u00f4nant ainsi un contr\u00f4le \u00ab\u00a0<\/span><em style=\"color: rgb(0, 0, 0);\">in concreto<\/em><span style=\"color: rgb(0, 0, 0);\">\u00a0\u00bb.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Fid\u00e8le \u00e0 sa jurisprudence, la Cour de cassation rappelle que \u00ab\u00a0<\/span><em style=\"color: rgb(0, 0, 0);\">la loi doit \u00eatre la m\u00eame pour tous, soit qu\u2019elle prot\u00e8ge, soit qu\u2019elle punisse<\/em><span style=\"color: rgb(0, 0, 0);\">\u00a0\u00bb et r\u00e9affirme que le Bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb (qui laisse aux juges un pouvoir d\u2019appr\u00e9ciation selon les situations en fixant un montant minimal et maximal pour une m\u00eame anciennet\u00e9) est compatible avec l\u2019article 10 de la convention 158 de l\u2019OIT.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Cass. soc. 7 mai 2024 n\u00b022-24.594<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>La Cour de Cassation vient de rappeler ce principe une nouvelle fois, dans un arr\u00eat du 7 mai dernier, censurant la Cour d\u2019appel de Douai qui avait cru pouvoir s\u2019\u00e9carter du Bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb pr\u00e9vu \u00e0 l\u2019article L. 1235-3 du Code du travail.
