{"id":25266,"date":"2024-06-13T09:50:37","date_gmt":"2024-06-13T07:50:37","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=25266"},"modified":"2024-06-13T09:50:38","modified_gmt":"2024-06-13T07:50:38","slug":"formation-economique-sociale-environnementale-et-syndicale-les-precisions-de-la-cour-de-cassation","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/formation-economique-sociale-environnementale-et-syndicale-les-precisions-de-la-cour-de-cassation\/","title":{"rendered":"Formation \u00e9conomique, sociale, environnementale et syndicale : les pr\u00e9cisions de la Cour de cassation"},"content":{"rendered":"<p>Dans un arr\u00eat publi\u00e9 du 12 juin 2024 (n\u00b022-18.302), la Cour de cassation \u00e9tait appel\u00e9e \u00e0 se prononcer sur l\u2019articulation entre les dispositions de l\u2019article L. 2145-1 du Code du travail et celles de l\u2019article L. 2145-7.<\/p>\n<p><\/p>\n<p>Le premier pr\u00e9voit que <strong>les salari\u00e9s appel\u00e9s \u00e0 exercer des fonctions syndicales<\/strong> b\u00e9n\u00e9ficient du cong\u00e9 de formation \u00e9conomique, sociale, environnementale et syndicale, pr\u00e9vu \u00e0 l\u2019article L. 2145-5, sans que la dur\u00e9e du cong\u00e9 sur l\u2019ann\u00e9e ne puisse exc\u00e9der <strong>18 jours<\/strong>.<\/p>\n<p><\/p>\n<p>Le second dispose que \u00ab\u00a0<em>la dur\u00e9e totale des cong\u00e9s de formation \u00e9conomique, sociale et environnementale et de formation syndicale pris dans l\u2019ann\u00e9e par <\/em><strong><em>un salari\u00e9<\/em><\/strong><em> ne peut exc\u00e9der <\/em><strong><em>douze jours<\/em><\/strong>.\u00a0\u00bb.<\/p>\n<p><\/p>\n<p>Ce cong\u00e9 est de droit pour les salari\u00e9s, de sorte que si l\u2019employeur estime que l\u2019absence pourrait avoir des cons\u00e9quences pr\u00e9judiciables \u00e0 la production et \u00e0 la bonne marche de l\u2019entreprise, il doit solliciter l\u2019avis conforme du Comit\u00e9 social et \u00e9conomique \u2013 CSE (C. trav., art. L. 2145-11).<\/p>\n<p><\/p>\n<p>Dans l\u2019affaire port\u00e9e devant la Cour de cassation, un salari\u00e9 membre suppl\u00e9ant du CSE d\u2019\u00e9tablissement et d\u00e9l\u00e9gu\u00e9 syndical pour cet \u00e9tablissement avait sollicit\u00e9 un cong\u00e9 de formation \u00e9conomique, sociale, environnementale et syndicale de <strong>13 jours<\/strong>.<\/p>\n<p><\/p>\n<p>Consid\u00e9rant que la dur\u00e9e du cong\u00e9 \u00e9tait limit\u00e9e \u00e0 12 jours, l\u2019employeur avait refus\u00e9 d\u2019accorder au salari\u00e9 le 13<sup>\u00e8me<\/sup> jour de cong\u00e9.<\/p>\n<p><\/p>\n<p>Apr\u00e8s avoir rappel\u00e9 les termes de l\u2019article L. 2145-1 pr\u00e9cit\u00e9, la Cour de cassation juge que \u00ab\u00a0<strong><em>cette disposition est propre aux salari\u00e9s appel\u00e9s \u00e0 exercer des fonctions syndicales, auxquels les dispositions de l\u2019article L. 2145-7 ne sont pas applicables<\/em><\/strong>\u00a0\u00bb. Ainsi, la Cour pr\u00e9cise le champ d\u2019application propre \u00e0 ces deux dispositions.<\/p>\n<p><\/p>\n<p>En l\u2019esp\u00e8ce, le salari\u00e9 ayant des fonctions syndicales ne pouvait donc pas se voir opposer la limite de 12 jours.<\/p>\n<p><\/p>\n<p>La Cour pr\u00e9cise \u00e9galement que puisque c\u2019est la dur\u00e9e du cong\u00e9 qui \u00e9tait contest\u00e9e par l\u2019employeur, ce dernier n\u2019avait pas \u00e0 solliciter l\u2019avis conforme du CSE.<\/p>\n<p><\/p>\n<p>Enfin, la Haute Cour juge que le refus de l\u2019employeur \u00e9tant, en l&rsquo;esp\u00e8ce, abusif, le salari\u00e9 pouvait solliciter des dommages et int\u00e9r\u00eats, tout comme le syndicat qui invoquait un pr\u00e9judice caus\u00e9 \u00e0 l\u2019int\u00e9r\u00eat collectif de la profession.
