L&rsquo;int\u00e9ress\u00e9 \u00e9tait le seul cadre \u00e0 avoir \u00e9t\u00e9 licenci\u00e9 au titre de la restructuration op\u00e9r\u00e9e par l&#8217;employeur.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Pour rappel, la charge de la preuve en mati\u00e8re de discrimination est partag\u00e9e.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Lorsque le salari\u00e9 \u00e9tablit la mat\u00e9rialit\u00e9 de faits pr\u00e9cis et concordants constituant selon lui une discrimination, il appartient au juge d\u2019appr\u00e9cier si ces \u00e9l\u00e9ments, pris dans leur ensemble, permettent de pr\u00e9sumer l\u2019existence d\u2019une discrimination et, dans l\u2019affirmative, il incombe \u00e0 l\u2019employeur de prouver que ces agissements ne sont pas constitutifs d\u2019une discrimination et que sa d\u00e9cision est justifi\u00e9e par des \u00e9l\u00e9ments objectifs \u00e9trangers \u00e0 toute discrimination.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">Selon la cour d\u2019appel, le licenciement n\u2019\u00e9tait pas entach\u00e9 de nullit\u00e9 en raison de l\u2019absence de discrimination fond\u00e9e sur l\u2019\u00e9tat de sant\u00e9 du salari\u00e9.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">La Cour de cassation n\u2019a pas \u00e9t\u00e9 du m\u00eame avis.<\/p>\n<p class=\"ql-align-justify\"><\/p>\n<p class=\"ql-align-justify\">En jugeant que l\u2019employeur a licenci\u00e9 le salari\u00e9 pour des motifs tenant \u00e0 une r\u00e9organisation intervenue pendant son arr\u00eat maladie en raison de sa situation \u00e9conomique, en sorte que le licenciement n\u2019est pas survenu pour un motif discriminatoire, la cour d\u2019appel a statu\u00e9 par des motifs impropres \u00e0 \u00e9tablir que cette d\u00e9cision \u00e9tait justifi\u00e9e par des \u00e9l\u00e9ments objectifs \u00e9trangers \u00e0 toute discrimination, alors qu\u2019elle a constat\u00e9, pour d\u00e9clarer le licenciement injustifi\u00e9, que le motif \u00e9conomique invoqu\u00e9 n\u2019\u00e9tait pas \u00e9tabli d\u00e8s lors que les donn\u00e9es comptables relatives aux 3 exercices sur lesquelles l\u2019employeur s\u2019appuyait ne permettaient pas d\u2019\u00e9tablir l\u2019existence de difficult\u00e9s \u00e9conomiques \u00e0 la date du licenciement.<\/p>\n<p><\/p>\n<p><a href=\"https:\/\/www.courdecassation.fr\/decision\/668e2436fcf93851fdd644df\" target=\"_blank\" rel=\"noopener\">https:\/\/www.courdecassation.fr\/decision\/668e2436fcf93851fdd644df<\/a><\/p>\n<p>\u00a0<\/p>\n<p><\/p>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Dans l&rsquo;affaire ayant donn\u00e9 lieu \u00e0 l&rsquo;arr\u00eat de la Cour de cassation (22-16.805), le salari\u00e9, en arr\u00eat de travail pendant plus de 2 ans, s&rsquo;\u00e9tait vu imposer de solder ses cong\u00e9s par son employeur, lequel l&rsquo;avait ensuite licenci\u00e9 pour motif \u00e9conomique avant qu&rsquo;il n&rsquo;ait pu reprendre son poste.
