style=\"color: rgb(0, 0, 0);\">Par un arr\u00eat du 2 octobre 2024 (n\u00b023-12702), la Cour de cassation a rappel\u00e9 que le salari\u00e9 licenci\u00e9 pour inaptitude physique d\u2019origine non professionnelle ne pouvait pas b\u00e9n\u00e9ficier d\u2019une indemnit\u00e9 compensatrice de pr\u00e9avis, d\u00e8s lors que les dispositions conventionnelles applicables ne pr\u00e9voyaient pas express\u00e9ment un tel versement.<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">En l\u2019esp\u00e8ce, suivant son licenciement pour inaptitude d\u2019origine non professionnelle et dispense de reclassement, une salari\u00e9e a saisi le Conseil de prud\u2019hommes aux fins d\u2019obtenir le paiement d\u2019une indemnit\u00e9 compensatrice de pr\u00e9avis fond\u00e9e sur les dispositions conventionnelles applicables \u00e0 la relation de travail.<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Le juge du fond a fait droit \u00e0 la demande de la salari\u00e9e, en consid\u00e9rant que les dispositions conventionnelles n&rsquo;excluaient le b\u00e9n\u00e9ficie du pr\u00e9avis, ou son indemnisation, qu\u2019en cas de faute grave ou de force majeure.<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">L\u2019employeur a alors form\u00e9 un pourvoi en cassation.<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">\u00a0<\/span><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">La Haute juridiction censure la d\u00e9cision du juge du fond, en rappelant que <\/span><em style=\"color: rgb(0, 0, 0);\">\u00ab\u00a0l\u2019indemnit\u00e9 de pr\u00e9avis n\u2019est pas due au salari\u00e9 qui est dans l\u2019impossibilit\u00e9 de l\u2019ex\u00e9cuter\u00a0\u00bb <\/em><span style=\"color: rgb(0, 0, 0);\">et rel\u00e8ve que les dispositions conventionnelles applicables <\/span><em style=\"color: rgb(0, 0, 0);\">\u00ab\u00a0ne pr\u00e9voient pas le versement d\u2019une telle indemnit\u00e9 dans le cas de la rupture du contrat de travail en raison de l\u2019inaptitude du salari\u00e9 cons\u00e9cutive \u00e0 une maladie ou un accident non professionnel\u00a0\u00bb.<\/em><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Autrement dit, le salari\u00e9 qui n\u2019est pas en mesure d\u2019exercer son pr\u00e9avis suivant une inaptitude d\u2019origine non professionnelle ne peut pas revendiquer le paiement d&rsquo;une indemnit\u00e9 compensatrice de pr\u00e9avis, sauf dispositions conventionnelles expresses.\u00a0<\/span><\/p>\n<p><\/p>\n<p><a
