{"id":26468,"date":"2024-12-10T06:38:16","date_gmt":"2024-12-10T05:38:16","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=26468"},"modified":"2024-12-10T06:38:18","modified_gmt":"2024-12-10T05:38:18","slug":"delai-de-prescription-en-matiere-de-contestation-du-statut-de-cadre-dirigeant","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/delai-de-prescription-en-matiere-de-contestation-du-statut-de-cadre-dirigeant\/","title":{"rendered":"D\u00e9lai de prescription en mati\u00e8re de contestation du statut de cadre dirigeant"},"content":{"rendered":"<p>Dans un arr\u00eat du 4 d\u00e9cembre 2024, la Cour de Cassation \u00ab\u00a0retoque\u00a0\u00bb un arr\u00eat de la Cour d\u2019appel de Dijon qui avait jug\u00e9e prescrite une demande de requalification du statut de cadre dirigeant en statut du cadre.<\/p>\n<p><\/p>\n<p>La Cour d\u2019appel de Dijon avait, en effet, appliqu\u00e9 le d\u00e9lai de prescription de 2 ans relatif \u00e0 l\u2019ex\u00e9cution du contrat de travail.<\/p>\n<p><\/p>\n<p>A cet \u00e9gard, la Cour de cassation juge classiquement que\u00a0: \u00ab\u00a0<em>La dur\u00e9e de la prescription [est] d\u00e9termin\u00e9e par la nature de la cr\u00e9ance invoqu\u00e9e\u00a0\u00bb.<\/em><\/p>\n<p><\/p>\n<p>Or, en l\u2019esp\u00e8ce, la nature de la cr\u00e9ance \u00e9tait salariale. Le salari\u00e9 demandait, en effet, un rappel de salaire fond\u00e9 sur une contestation de sa qualit\u00e9 de cadre dirigeant.<\/p>\n<p><\/p>\n<p>Sa demande \u00e9tait donc soumise \u00e0 la prescription triennale de l\u2019article L. 3245-1 du Code du travail.
