{"id":26706,"date":"2025-02-28T13:59:36","date_gmt":"2025-02-28T12:59:36","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=26706"},"modified":"2025-02-28T13:59:39","modified_gmt":"2025-02-28T12:59:39","slug":"nouveautes-sur-la-commission-sante-securite-et-conditions-de-travail-cssct","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/nouveautes-sur-la-commission-sante-securite-et-conditions-de-travail-cssct\/","title":{"rendered":"Nouveaut\u00e9s sur la Commission Sant\u00e9, S\u00e9curit\u00e9 et Conditions de Travail (CSSCT)"},"content":{"rendered":"<p>La Cour de cassation a rendu deux arr\u00eats le 26 f\u00e9vrier 2025 (n\u00b023-20.714) et (n\u00b024-12.295) int\u00e9ressant la Commission Sant\u00e9, S\u00e9curit\u00e9 et Conditions de Travail (CSSCT).<\/p>\n<p><\/p>\n<p><span style=\"color: rgb(51, 51, 51);\">Rappelons que :<\/span><\/p>\n<ul>\n<li><span style=\"color: rgb(51, 51, 51);\">la CSSCT est obligatoirement cr\u00e9\u00e9e dans les entreprises ou \u00e9tablissements distincts d&rsquo;au moins 300 salari\u00e9s, ainsi que dans certains \u00e9tablissements \u00ab\u00a0sensibles\u00a0\u00bb (installations nucl\u00e9aires, Seveso seuil haut), cf. art. L. 2315-36 du Code du travail,<\/span><\/li>\n<li><span style=\"color: rgb(51, 51, 51);\">la CSSCT est compos\u00e9e de l&#8217;employeur ou son repr\u00e9sentant, qui la pr\u00e9sident, ainsi qu&rsquo;<\/span><em style=\"color: rgb(51, 51, 51);\">a minima <\/em><span style=\"color: rgb(51, 51, 51);\"> 3 membres repr\u00e9sentants du personnel, dont au moins un repr\u00e9sentant du second coll\u00e8ge, ou le cas \u00e9ch\u00e9ant du troisi\u00e8me coll\u00e8ge au regard du nombre d&rsquo;ing\u00e9nieurs et cadres sup\u00e9rieur \u00e0 25 (cf. art. L. 2314-11 du Code du travail),cf. art. L. 2315-39 du Code du travail,<\/span><\/li>\n<li><span style=\"color: rgb(51, 51, 51);\">\u00e9tant pr\u00e9cis\u00e9 que les membres de la CSSCT, qui exercent par d\u00e9l\u00e9gation du Comit\u00e9 Social et Economique (CSE) les attributions de ce dernier relatives \u00e0 la sant\u00e9, \u00e0 la s\u00e9curit\u00e9 et aux conditions de travail, sont d\u00e9sign\u00e9s par le CSE parmi ses membres (art. L. 2315-39 pr\u00e9cit\u00e9). <\/span><\/li>\n<\/ul>\n<p><\/p>\n<p><span style=\"color: rgb(51, 51, 51);\">Le premier arr\u00eat (n\u00b023-20.714) nous renseigne quant \u00e0 la contestation de ces d\u00e9signations de membres de la CSSCT par le CSE, laquelle rel\u00e8ve de la comp\u00e9tence du Tribunal judiciaire, saisi par voie de requ\u00eate, <\/span><strong style=\"color: rgb(51, 51, 51);\">lequel statue en dernier ressort<\/strong><span style=\"color: rgb(51, 51, 51);\">, sa d\u00e9cision \u00e9tant susceptible d&rsquo;un pourvoi en cassation sous un d\u00e9lai de 10 jours (rappelons ici que ce d\u00e9lai de 10 jours sera d\u00e9compt\u00e9 selon les articles 640 \u00e0 642 du Code de proc\u00e9dure civile, lesquels sont relatifs \u00e0 la computation des d\u00e9lais de proc\u00e9dure).<\/span><strong style=\"color: rgb(51, 51, 51);\"> Il n&rsquo;y a donc pas lieu de relever appel d&rsquo;une telle d\u00e9cision<\/strong><span style=\"color: rgb(51, 51, 51);\">.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(51, 51, 51);\">Le second arr\u00eat (n\u00b024-12.295) nous informe, pour la premi\u00e8re fois \u00e0 notre connaissance, que lorsqu&rsquo;il existe trois coll\u00e8ges \u00e9lectoraux au regard du nombre d&rsquo;ing\u00e9nieurs et cadres sup\u00e9rieur \u00e0 25 (cf. art.
