{"id":28056,"date":"2025-11-28T08:42:58","date_gmt":"2025-11-28T07:42:58","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=28056"},"modified":"2025-11-28T08:42:59","modified_gmt":"2025-11-28T07:42:59","slug":"une-demission-dans-le-contexte-dune-surcharge-de-travail-signalee-peut-etre-requalifiee-en-prise-dacte-au-tort-de-lemployeur","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/une-demission-dans-le-contexte-dune-surcharge-de-travail-signalee-peut-etre-requalifiee-en-prise-dacte-au-tort-de-lemployeur\/","title":{"rendered":"Une d\u00e9mission dans le contexte d\u2019une surcharge de travail signal\u00e9e peut \u00eatre requalifi\u00e9e en prise d\u2019acte au tort de l\u2019employeur"},"content":{"rendered":"<p>C\u2019est pr\u00e9cis\u00e9ment ce que la Cour de Cassation vient de juger dans un arr\u00eat du 13 novembre 2025 (Cass.soc. 13 novembre 2025 n\u00b023-23535).<\/p>\n<p><\/p>\n<p>Dans cette affaire, le salari\u00e9 a d\u00e9missionn\u00e9 de ses fonctions \u00e0 la suite d\u2019une surcharge de travail qu\u2019il avait signal\u00e9e \u00e0 son employeur \u00e0 plusieurs reprises.<\/p>\n<p><\/p>\n<p>Il a ensuite contest\u00e9 sa convention de forfait jours devant le Conseil de prud\u2019hommes et demand\u00e9 la requalification de sa d\u00e9mission en prise d\u2019acte aux torts de l\u2019employeur.<\/p>\n<p><\/p>\n<p>La Cour d\u2019appel de Bourges a admis l\u2019existence d\u2019une surcharge de travail depuis plusieurs ann\u00e9es. Toutefois, pour la Cour, cette surcharge ne constituait pas une circonstance contemporaine et d\u00e9terminante de la d\u00e9mission rendant impossible la poursuite du contrat de travail.<\/p>\n<p><\/p>\n<p>Ce raisonnement est cass\u00e9 par la Cour de cassation qui consid\u00e8re que\u00a0:<\/p>\n<p><\/p>\n<p>\u00ab\u00a0<em>En statuant ainsi, alors qu&rsquo;elle avait constat\u00e9 que\u00a0:<\/em><\/p>\n<ul>\n<li><em>le salari\u00e9 avait, pr\u00e9alablement \u00e0 la d\u00e9mission, fait \u00e9tat de l&rsquo;importance de sa charge de travail lors des examens m\u00e9dicaux r\u00e9alis\u00e9s pour le contr\u00f4le de la sant\u00e9 au travail, <\/em><\/li>\n<li><em>alert\u00e9 sa hi\u00e9rarchie par un courriel du 10 octobre 2019 sur sa situation critique du fait de cette charge de travail devenue insupportable,<\/em><\/li>\n<li><em>sollicit\u00e9 une visite du m\u00e9decin du travail le 24 octobre 2019 en signalant un contexte de surcharge de travail, <\/em><\/li>\n<li><em>et expos\u00e9, lors de l&rsquo;entretien individuel d&rsquo;\u00e9valuation annuelle ayant eu lieu le 2 f\u00e9vrier 2021 et dans ses commentaires annex\u00e9s du 22 mars 2021, que l&rsquo;\u00e9quilibre entre la vie professionnelle et la vie personnelle n&rsquo;existait pas, que son p\u00e9rim\u00e8tre d&rsquo;intervention, trop vaste, sur diff\u00e9rents fuseaux horaires et sans \u00ab backup \u00bb, entra\u00eenait une charge mentale tr\u00e8s \u00e9lev\u00e9e et permanente, mal v\u00e9cue personnellement, <\/em><strong><em><u>ce dont elle aurait d\u00fb d\u00e9duire l&rsquo;existence d&rsquo;un diff\u00e9rend rendant la d\u00e9mission \u00e9quivoque, la cour d&rsquo;appel a viol\u00e9 les textes susvis\u00e9s<\/u><\/em><\/strong><em>\u00a0\u00bb<\/em><\/li>\n<\/ul>\n<p><em>\u00a0<\/em><\/p>\n<p>Attention donc \u00e0 bien suivre la charge de travail des cadres aux forfaits jours et a apport\u00e9 une r\u00e9ponse aux alertes donn\u00e9es.<\/p>\n<p><\/p>\n<p><a href=\"https:\/\/www.courdecassation.fr\/decision\/691595885cc9fa7cae5a6d0d\"
