{"id":28276,"date":"2026-01-30T12:15:22","date_gmt":"2026-01-30T11:15:22","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=28276"},"modified":"2026-01-30T12:15:24","modified_gmt":"2026-01-30T11:15:24","slug":"licenciement-a-loccasion-du-transfert-dune-entite-economique-autonome","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/licenciement-a-loccasion-du-transfert-dune-entite-economique-autonome\/","title":{"rendered":"Licenciement \u00e0 l\u2019occasion du transfert d\u2019une entit\u00e9 \u00e9conomique autonome"},"content":{"rendered":"<p><span style=\"color: rgb(0, 0, 0);\">En cas de transfert d\u2019une entit\u00e9 \u00e9conomique autonome, les contrats de travail attach\u00e9s \u00e0 l\u2019entit\u00e9 transf\u00e9r\u00e9e doivent se poursuivre \u00e0 l\u2019identique chez le repreneur (L. 1224-1 du Code du travail).\u00a0C<\/span><span style=\"color: black;\">e transfert est op\u00e9r\u00e9 par l\u2019effet de la loi, sans aucune notification particuli\u00e8re.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span style=\"color: black;\">Un licenciement qui intervient lors du transfert, en violation de l\u2019article L. 1224-1 du code du travail, est, selon une jurisprudence constante, \u00ab\u00a0<\/span><em style=\"color: black;\">sans effet<\/em><span style=\"color: black;\">\u00a0\u00bb (cass. soc. 3 avril 2001, n\u00b0\u00a098-44778) et non nul. Le salari\u00e9 peut alors, \u00e0 son choix, demander au repreneur la poursuite du contrat de travail ill\u00e9galement rompu ou demander \u00e0 l\u2019auteur du licenciement la r\u00e9paration du pr\u00e9judice en r\u00e9sultant (Cass. soc., 26 juin 2012, n\u00b0\u00a011-10108).<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: black;\">Dans l\u2019esp\u00e8ce auant donn\u00e9 lieu \u00e0 l&rsquo;arr\u00eat de la Cour de cassation, en date du 21 janvier 2026 (n\u00b024-21.142), un salari\u00e9 avait \u00e9t\u00e9 ill\u00e9galement licenci\u00e9 par le c\u00e9dant \u00e0 l\u2019occasion du transfert et avait donc contest\u00e9 son licenciement au motif qu\u2019il \u00e9tait contraire aux dispositions de l\u2019article L. 1224-1 du Code du travail<\/span>.<\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">La Cour d\u2019appel de Grenoble lui a donn\u00e9 raison et lui a allou\u00e9 une indemnit\u00e9 sup\u00e9rieure au plafond du bar\u00e8me Macron, assimilant la situation \u00e0 un licenciement nul.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: black;\">L\u2019arr\u00eat de la Cour d\u2019appel de Grenoble a \u00e9t\u00e9 cass\u00e9 par la Cour de Cassation qui rappelle, dans son arr\u00eat du 21 janvier 2026, qu\u2019en l&rsquo;absence de texte sp\u00e9cial, les cons\u00e9quences dommageables, r\u00e9sultant de la perte de l&#8217;emploi dans cette situation, doivent \u00eatre r\u00e9par\u00e9es conform\u00e9ment aux dispositions de l&rsquo;article L. 1235-3 du Code du travail (en application du Bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb).<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: black;\">Cet arr\u00eat applique le principe classique selon lequel il n\u2019y a pas de nullit\u00e9 sans texte<\/span><span style=\"color: black; background-color: rgb(250, 250, 250);\">.<\/span><\/p>\n<p><\/p>\n<p><\/p>\n<p><a href=\"https:\/\/www.courdecassation.fr\/decision\/69707ac3cdc6046d471339f7\" target=\"_blank\">https:\/\/www.courdecassation.fr\/decision\/69707ac3cdc6046d471339f7<\/a><\/p>\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cass.soc. 21 janvier 2026 n\u00b054-21142<\/p>\n","protected":false},"author":3,"featured_media":28274,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_seopress_robots_primary_cat":"","_seopress_titles_title":"","_seopress_titles_desc":"","_seopress_robots_index":"","footnotes":""},"categories":[31],"tags":[],"class_list":["post-28276","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-actualites-en-droit-social"],"acf":[],"_links":{"self":[{"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/posts\/28276","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/users\/3"}],"replies":[{"embeddable":true,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/comments?post=28276"}],"version-history":[{"count":3,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/posts\/28276\/revisions"}],"predecessor-version":[{"id":28281,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/posts\/28276\/revisions\/28281"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/media\/28274"}],"wp:attachment":[{"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/media?parent=28276"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/categories?post=28276"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.voltaire-avocats.com\/fr\/wp-json\/wp\/v2\/tags?post=28276"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
