{"id":28656,"date":"2026-04-10T13:21:13","date_gmt":"2026-04-10T11:21:13","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/?p=28656"},"modified":"2026-04-10T13:21:29","modified_gmt":"2026-04-10T11:21:29","slug":"non-respect-du-droit-a-la-deconnexion","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/non-respect-du-droit-a-la-deconnexion\/","title":{"rendered":"Non-respect all\u00e9gu\u00e9 du droit \u00e0 la d\u00e9connexion"},"content":{"rendered":"<p><span style=\"color: rgb(0, 0, 0);\">Dans un arr\u00eat du 25 mars 2026 (Cass. soc., 25 mars 2026, n\u00b0 24\u201121.098), la chambre sociale est venue apporter des pr\u00e9cisions sur le non\u2011respect du droit \u00e0 la d\u00e9connexion d\u2019un salari\u00e9.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">En l\u2019esp\u00e8ce, un Chef d&rsquo;agence, statut cadre dirigeant, licenci\u00e9 pour inaptitude physique apr\u00e8s plusieurs mois d\u2019arr\u00eat de travail, sollicitait des dommages\u2011int\u00e9r\u00eats pour non\u2011respect du droit \u00e0 la d\u00e9connexion, car durant son arr\u00eat il consid\u00e9rait avoir \u00e9t\u00e9 sollicit\u00e9 par courriel pour ex\u00e9cuter diverses missions ponctuelles portant sur des cl\u00f4tures financi\u00e8res mensuelles, la signature de contrats de travail et l\u2019attribution de primes \u00e0 ses collaborateurs, sollicitations auxquelles le salari\u00e9 avait volontairement r\u00e9pondu.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Le salari\u00e9 soutenait ainsi que l\u2019employeur, qui n\u2019avait mis en place aucun dispositif d\u00e9di\u00e9 \u00e0 la mise en \u0153uvre du droit \u00e0 la d\u00e9connexion et l\u2019avait sollicit\u00e9 durant son arr\u00eat de travail, avait manqu\u00e9 au respect de ce droit, ce qui lui ouvrait droit \u00e0 l\u2019indemnisation du pr\u00e9judice subi.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">La Cour de cassation confirme l\u2019arr\u00eat d\u2019appel d\u00e9boutant le salari\u00e9 de cette demande : \u00ab<\/span><em style=\"color: rgb(0, 0, 0);\"> L\u2019arr\u00eat, qui a constat\u00e9 qu\u2019aucun \u00e9l\u00e9ment ne venait d\u00e9montrer une obligation du salari\u00e9 de traiter imm\u00e9diatement les courriels re\u00e7us, d\u00e8s lors qu\u2019ils constituaient pour la plupart des notifications automatiques, le salari\u00e9 ayant fait le choix de r\u00e9pondre en se connectant spontan\u00e9ment \u00e0 son poste informatique professionnel pour ce faire et en r\u00e9alisant des actions ponctuelles, n\u2019encourt pas les griefs du moyen. <\/em><span style=\"color: rgb(0, 0, 0);\">\u00bb<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Le fait que l\u2019employeur n\u2019ait pas mis en place de dispositif d\u00e9di\u00e9 \u00e0 la mise en \u0153uvre du droit \u00e0 la d\u00e9connexion n\u2019est pas retenu comme circonstance \u00ab\u00a0aggravante\u00a0\u00bb par la Cour de cassation.<\/span><\/p>\n<p><\/p>\n<p><span style=\"color: rgb(0, 0, 0);\">Cette solution pourrait \u00eatre \u00e9tendue \u00e0 d\u2019autres hypoth\u00e8ses dans lesquelles le droit \u00e0 la d\u00e9connexion peut \u00eatre invoqu\u00e9 : courriels envoy\u00e9s en soir\u00e9e, le week\u2011end ou pendant les cong\u00e9s.
