{"id":28749,"date":"2026-05-05T13:06:01","date_gmt":"2026-05-05T11:06:01","guid":{"rendered":"https:\/\/www.voltaire-avocats.com\/partage-dinformations-entre-assurance-maladie-et-services-de-sante-au-travail-les-modalites-precisees-par-decrets\/"},"modified":"2026-05-05T13:06:02","modified_gmt":"2026-05-05T11:06:02","slug":"partage-dinformations-entre-assurance-maladie-et-services-de-sante-au-travail-les-modalites-precisees-par-decrets","status":"publish","type":"post","link":"https:\/\/www.voltaire-avocats.com\/fr\/partage-dinformations-entre-assurance-maladie-et-services-de-sante-au-travail-les-modalites-precisees-par-decrets\/","title":{"rendered":"Partage d\u2019informations entre assurance maladie et services de sant\u00e9 au travail : les modalit\u00e9s pr\u00e9cis\u00e9es par d\u00e9crets"},"content":{"rendered":"<p>Les modalit\u00e9s du partage d\u2019informations entre l\u2019assurance maladie et les services de pr\u00e9vention et de sant\u00e9 au travail (SPST) sont d\u00e9sormais fix\u00e9es.<\/p>\n<p><\/p>\n<p>Pris le 28 avril 2026, deux d\u00e9crets pr\u00e9cisent ainsi le cadre de ces \u00e9changes visant l\u2019identification des salari\u00e9s en risque de d\u00e9sinsertion professionnelle.<\/p>\n<p><\/p>\n<p>Ils pr\u00e9voient\u00a0:<\/p>\n<p><\/p>\n<ul>\n<li>Que lorsqu\u2019un salari\u00e9 est en arr\u00eat de travail continu d\u2019au moins six mois, le service du contr\u00f4le m\u00e9dical de l\u2019assurance maladie transmet au SPST comp\u00e9tent certaines informations permettant d\u2019identifier un risque de d\u00e9sinsertion professionnelle (Art. L. 315-4 et D. 315-6 nouveaux du Code de la s\u00e9curit\u00e9 sociale). Sont toutefois exclus les arr\u00eats li\u00e9s \u00e0 des pathologies engageant le pronostic vital ou n\u00e9cessitant des soins actifs et continus. Cet \u00e9change est strictement subordonn\u00e9 \u00e0 l\u2019accord pr\u00e9alable du salari\u00e9, recueilli et conserv\u00e9 par l\u2019assurance maladie, et r\u00e9vocable \u00e0 tout moment (Art. R. 315-8 nouveau du Code de la s\u00e9curit\u00e9 sociale). Les donn\u00e9es transmises se limitent au NIR, \u00e0 la dur\u00e9e de l\u2019arr\u00eat et \u00e0 certains \u00e9l\u00e9ments m\u00e9dicaux strictement n\u00e9cessaires. Ce dispositif est applicable depuis le 30 avril 2026.<\/li>\n<\/ul>\n<p><\/p>\n<ul>\n<li>Qu\u2019en retour, le SPST ayant re\u00e7u ces informations doit communiquer au service du contr\u00f4le m\u00e9dical des \u00e9l\u00e9ments relatifs au poste et aux conditions de travail du salari\u00e9, notamment les propositions d\u2019am\u00e9nagement ou d\u2019adaptation, les informations issues d\u2019un \u00e9ventuel avis d\u2019inaptitude, ainsi qu\u2019une appr\u00e9ciation sur la n\u00e9cessit\u00e9 d\u2019un accompagnement social (Art. L. 4622-2-1 et D. 4622-4-1 nouveaux du Code de la s\u00e9curit\u00e9 sociale). L\u00e0 encore, seules les informations strictement n\u00e9cessaires peuvent \u00eatre transmises, dans un d\u00e9lai de 30 jours et <em>via <\/em>une messagerie s\u00e9curis\u00e9e, sous r\u00e9serve de l\u2019accord du salari\u00e9 recueilli par le SPST.
